Even as we make major strides through our own impact litigation, we see tremendous untapped potential to advance gun safety through the courts,\u201d he continued.<\/p>\n\n\n\n<p>\u201cBy making it easier for smaller and less resourced law firms to represent clients with cases that can have a broad impact, we expect this fund will start a new and important chapter in gun violence prevention,\u201d Tirschwell concluded.&nbsp;<\/p>\n\n\n\n<p>Categories of litigation that Everytown Law is willing to back include: &nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Claims seeking accountability for survivors of gun violence from potentially liable firearm manufacturers, distributors and retailers;<\/li><li>Claims that product defects caused unintentional shootings;<\/li><li>Claims based on unfair or deceptive marketing and\/or sales practices;<\/li><li>Challenges to laws that increase the risk of armed confrontation and gun violence;<\/li><li>Lawsuits arising out of unjustified shootings or armed intimidation;<\/li><li>Lawsuits seeking to compel state and local officials to enforce gun safety laws;<\/li><li>Claims to compel disclosure of gun violence-related public records and data; and<\/li><li>Appeals arising in any of the above categories of litigation.<\/li><\/ul>\n\n\n\n<p>One of the key goals of the anti-gun lobby is to bankrupt the gun industry by making it pay for the criminal acts of third parties.&nbsp; &nbsp;<\/p>\n\n\n\n<p>Federal law, under the<a href=\"https:\/\/en.wikipedia.org\/wiki\/Protection_of_Lawful_Commerce_in_Arms_Act\" target=\"_blank\" class=\"clickTracking\" campaign=\"everytown-law-announces-3m-war-chest-to-eliminate-2a-rights-via-the-courts\" title=\"Everytown Law Announces $3M War Chest to Eliminate 2A Rights Via the Courts\u00a0\"> Protection of Lawful Commerce in Arms Act (PLCAA)<\/a>, is designed to shield gun makers and sellers from such frivolous lawsuits. &nbsp;<\/p>\n\n\n\n<p>However, anti-gun litigators have been persistent when it comes to challenging the PLCAA. &nbsp;<\/p>\n\n\n\n<p>In fact, just this week, they scored a victory as Remington Arms&#8217; insurers have offered to<a href=\"https:\/\/www.reuters.com\/legal\/litigation\/everytown-law-aims-curb-gun-violence-with-new-litigation-fund-2021-07-28\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"everytown-law-announces-3m-war-chest-to-eliminate-2a-rights-via-the-courts\" title=\"Everytown Law Announces $3M War Chest to Eliminate 2A Rights Via the Courts\u00a0\"> pay $33 million to nine Sandy Hook families<\/a> to settle a lawsuit that claimed the gun company\u2019s<a href=\"https:\/\/www.gunsamerica.com\/digest\/court-allows-sandy-hook\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"everytown-law-announces-3m-war-chest-to-eliminate-2a-rights-via-the-courts\" title=\"Everytown Law Announces $3M War Chest to Eliminate 2A Rights Via the Courts\u00a0\"> marketing practices were, in part, responsible<\/a> for the 2012 killing that left 26 dead. \u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/new-from-springfield-armory-the-emissary-1911-pistol\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"everytown-law-announces-3m-war-chest-to-eliminate-2a-rights-via-the-courts\" title=\"Everytown Law Announces $3M War Chest to Eliminate 2A Rights Via the Courts\u00a0\">New from Springfield Armory: The Emissary 1911 Pistol<\/a><\/h2>\n\n\n\n<p>Making matters worse is a New York bill that Gov. Andrew Cuomo <a href=\"https:\/\/www.gunsamerica.com\/digest\/ny-gov-cuomo-declares-first-in-the-nation-gun-violence-disaster-emergency\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"everytown-law-announces-3m-war-chest-to-eliminate-2a-rights-via-the-courts\" title=\"Everytown Law Announces $3M War Chest to Eliminate 2A Rights Via the Courts\u00a0\">signed into law this month<\/a> that allows anyone to take legal action against gun makers if the products they make are deemed to be a \u201cpublic nuisance.\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cThe products can be considered a public nuisance even if the gun manufacturer did not purposely cause harm to the public,\u201d states Cuomo\u2019s <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-cuomo-signs-legislation-holding-gun-manufacturers-accountable-and-closing-harmful-gun\" target=\"_blank\" class=\"clickTracking\" campaign=\"everytown-law-announces-3m-war-chest-to-eliminate-2a-rights-via-the-courts\" title=\"Everytown Law Announces $3M War Chest to Eliminate 2A Rights Via the Courts\u00a0\">press release<\/a>. &nbsp;<\/p>\n\n\n\n<p>With its $3 million war chest, Everytown Law is going to put the gun industry on the defensive.&nbsp; Even if all the lawsuits fail in the end, gun dealers and makers are going to have to put valuable time, money and resources into defending their right to sell and make legal products for law-abiding citizens. &nbsp;<\/p>\n\n\n\n<p>It also has a diversionary effect as well in that it takes attention away from the true sources of gun-related crime: violent offenders.&nbsp;<\/p>\n\n\n\n<p>\u201cClaims against firearm manufacturers were consistently thrown out of courts prior to PLCAA\u2019s enactment,\u201d Mark Oliva, public affairs director for the National Shooting Sports Foundation, told GunsAmerica via email.&nbsp;<\/p>\n\n\n\n<p>\u201cThis is Everytown\u2019s pandering to victims of crimes to hoodwink them into lending their tragic stories to pursue Everytown\u2019s agenda of clogging up the courts with baseless claims instead of holding criminals accountable for their actions,\u201d Oliva continued. &nbsp;<\/p>\n\n\n\n<p>In the end, nothing good will come from this litigation fund.
