(Photo: Yolo County Superior Court)<\/em><\/figcaption><\/figure>\n\n\n\n<p>A California county judge refused this week to use the state\u2019s \u201cred flag\u201d law to confiscate the firearms of a man accused of resisting\/obstructing an officer in a 2018 incident involving an altercation with his son.<\/p>\n\n\n\n<p>Yolo County Superior Court Judge David W. Reed made the decision despite a \u201cstrenuous request\u201d from deputy district attorney Alex Kian, according to the <a href=\"https:\/\/www.davisvanguard.org\/2021\/07\/judge-refuses-to-confiscate-defendants-guns-despite-prosecutors-request\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-judge-refuses-to-confiscate-firearms\" title=\"California Judge Refuses to Confiscate Firearms: The Court Shouldn\u2019t Have \u201cAnything to Do with the Guns\u201d\" target=\"_blank\" rel=\"noreferrer noopener\">Davis Vanguard<\/a> newspaper.<\/p>\n\n\n\n<p>Officers allegedly were \u201cconcerned for their safety\u201d due to the presence of Trent Stonerock\u2019s loaded firearms as they attempted to subdue Stonerock during the course of the 2018 incident. Kian asked that Stonerock be forced to surrender his firearms for a year in order to communicate to Stonerock that he\u2019s getting off with a misdemeanor and \u201cas an incentive to comply.\u201d<\/p>\n\n\n\n<p>Kian also accused Stonerock of failing to \u201cdemonstrate proper gun ownership\u201d by frequently leaving his guns loaded.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/feinstein-introduces-federal-red-flag-confiscation-legislation\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-judge-refuses-to-confiscate-firearms\" title=\"California Judge Refuses to Confiscate Firearms: The Court Shouldn\u2019t Have \u201cAnything to Do with the Guns\u201d\">Feinstein Introduces Federal \u2018Red Flag\u2019 Confiscation Legislation<\/a><\/h2>\n\n\n\n<p>Judge Reed disagreed. Telling Kian that the court shouldn\u2019t have \u201canything to do with the guns,\u201d he argued that the court shouldn\u2019t confiscate Stonerock\u2019s firearms even if he were convicted for his charges.<\/p>\n\n\n\n<p>Stonerock\u2019s defense attorney, Hendrick Crowell, also pointed out that his client has been to private therapy sessions and hasn\u2019t been in any further trouble three years after his initial arrest.<\/p>\n\n\n\n<p>\u201cHe\u2019s [Stonerock] is a lawful gun owner. [The incident] was at his home\u2026 he was close to his guns, [and] there was a struggle over the police trying to secure the guns and the court granted the diversion request, and I think it\u2019s more appropriate that he just do some community service,\u201d Cromwell said, according to the Vanguard.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/doj-publishes-guidance-for-red-flag-confiscation-legislation\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-judge-refuses-to-confiscate-firearms\" title=\"California Judge Refuses to Confiscate Firearms: The Court Shouldn\u2019t Have \u201cAnything to Do with the Guns\u201d\">DOJ Publishes Guidance for \u2018Red Flag\u2019 Confiscation Legislation<\/a><\/h2>\n\n\n\n<p>Judge Reed granted Stonerock\u2019s misdemeanor diversion for a year and allowed him to keep his firearms. Stonerock will have to complete 40 hours of community service and is scheduled for a review hearing in July of 2022.<\/p>\n\n\n\n<p>Reed was appointed by former Republican California Gov. Arnold Schwarzenegger in 2009. He was reelected in 2013 and 2019, and he handles criminal cases for Yolo County. Prior to serving on the bench, he practiced law at his own private firm for 23 years.<\/p>\n\n\n\n<p>Judge Reed\u2019s decision is an unfortunately rare outcome in the Golden State. California enacted its red flag law in 2016, and in May of this year, the Los Angeles Times <a href=\"https:\/\/sports.yahoo.com\/california-sees-record-number-guns-004538705.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-judge-refuses-to-confiscate-firearms\" title=\"California Judge Refuses to Confiscate Firearms: The Court Shouldn\u2019t Have \u201cAnything to Do with the Guns\u201d\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> that judges had issued a record-breaking 1,285 \u201cgun-violence restraining orders\u201d in 2020.
