(Photo: Rob Bonta Facebook)<\/em><\/figcaption><\/figure>\n\n\n\n<p>In a widely anticipated move, the U.S. 9<sup>th<\/sup> Circuit Court of Appeals blocked California judge Robert Benitez\u2019s ruling that overturned the state\u2019s \u201cassault weapon\u201d ban and called the law a \u201cfailed experiment.\u201d<\/p>\n\n\n\n<p>In its one-page ruling, the court issued a stay on implementing Benitez\u2019s decision until another related \u201cassault weapon\u201d case, <em>Rupp v. Bonta<\/em>, plays out. The stay remains in effect until \u201cfurther order of this court,\u201d according to the <a href=\"https:\/\/oag.ca.gov\/system\/files\/attachments\/press-docs\/Miller%20Order.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"9th-circuit-puts-the-kibosh-on-california-assault-weapon-ruling\" title=\"9th Circuit Puts the Kibosh on California 'Assault Weapon' Ruling\" target=\"_blank\" rel=\"noreferrer noopener\">document<\/a>.<\/p>\n\n\n\n<p>California Attorney General Rob Bonta had vowed to appeal the decision, and he celebrated in a Twitter post the 9<sup>th<\/sup> Circuit\u2019s ruling.<\/p>\n\n\n\n<p>\u201cThis leaves our assault weapons laws in effect while appellate proceedings continue,\u201d he said. \u201cWe won&#8217;t stop defending these life-saving laws.\u201d<\/p>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/BREAKING?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"9th-circuit-puts-the-kibosh-on-california-assault-weapon-ruling\" title=\"9th Circuit Puts the Kibosh on California 'Assault Weapon' Ruling\">#BREAKING<\/a>: The 9th Circuit granted our motion to stay the district court\u2019s ruling in Miller v. Bonta<\/em>, blasted the 9<sup>th<\/sup> Circuit\u2019s ruling as a decision to choose \u201ctyranny over human lives and rights.\u201d<\/p>\n\n\n\n<p>&#8220;Tens of millions of Californians have suffered under the State\u2019s unconstitutional and oppressive gun control scheme for far too long,&#8221; the organization said. &#8220;Today the Ninth Circuit chose government tyranny over human lives and rights. If the federal courts wish to remain a relevant part of this Republic\u2019s system of ordered liberty, then they should do their [well-paid, lifetime-tenure] jobs and stand up for the rights of the people of the United States in every case\u2014not merely when it is convenient to them and anti-rights radicals like Governor Gavin Newsom and Attorney General Rob Bonta.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/california-lawmakers-move-to-force-microstamping-on-gun-industry\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"9th-circuit-puts-the-kibosh-on-california-assault-weapon-ruling\" title=\"9th Circuit Puts the Kibosh on California 'Assault Weapon' Ruling\">California Lawmakers Move to Force \u2018Microstamping\u2019 on Gun Industry<\/a><\/h2>\n\n\n\n<p>The three-judge panel of the 9<sup>th<\/sup> Circuit that issued that stay is composed of U.S. Circuit Court Judges Dorothy Nelson, Jacqueline Nguyen, and Barry Silverman, who were appointed by Presidents Carter, Obama, and Clinton, respectively.<\/p>\n\n\n\n<p>The 9<sup>th<\/sup> Circuit is a historically anti-gun court and has issued a wide variety of rulings upholding some of the country\u2019s most restrictive gun control policies.<\/p>\n\n\n\n<p>The Supreme Court has punted on the \u201cassault weapon\u201d question in recent years, but this year, the court agreed to hear a gun control case for the first time in over a decade. With the addition of Justice Amy Coney Barrett, many observers hope the court has enough pro-2A justices to rule in favor of gun rights.
