Of Justice (DOJ) voicing \u201cdeep concern\u201d about the implications of the notice for proposed guidance on \u201c<a href=\"https:\/\/www.regulations.gov\/document\/ATF-2021-0002-0001\" target=\"_blank\" class=\"clickTracking\" campaign=\"make-millions-of-law-abiding-citizens-felons-overnight-lawmakers-warn-doj-about-brace-ban\" title=\"\u2018Make Millions of Law-Abiding Citizens Felons Overnight,\u2019 Lawmakers Warn DOJ About Brace Ban\">Factoring Criteria for Firearms with Attached \u2018Stabilizing Braces.\u2019<\/a>\u201d&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/the-atf-is-proposing-new-rules-for-braced-firearms-already-meeting-resistance\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"make-millions-of-law-abiding-citizens-felons-overnight-lawmakers-warn-doj-about-brace-ban\" title=\"\u2018Make Millions of Law-Abiding Citizens Felons Overnight,\u2019 Lawmakers Warn DOJ About Brace Ban\">The ATF is Proposing New Rules for Braced Firearms, Already Meeting Resistance<\/a><\/h2>\n\n\n\n<p>\u201cThe proposed guidance is alarming and jeopardizes the rights of law-abiding gun owners and disabled combat veterans across the country,\u201d wrote the members of Congress in the letter dated June 14, 2021. \u00a0<\/p>\n\n\n\n<p>\u201cShould this guidance go into effect, a disabled combat veteran who has chosen the best stabilizing brace for their disability is now a felon unless they turn in or destroy the firearm, destroy the brace, or pay a $200 tax,\u201d they continued.\u00a0 \u201cFurthermore it could make millions of law-abiding citizens felons overnight.\u201d \u00a0<\/p>\n\n\n\n<p>Here\u2019s a full copy of the letter:<\/p>\n\n\n\n\n\n\n\n<p><\/p>\n\n\n\n<p>While this letter helps the cause, we still have to do our part as well.&nbsp; To that end, the gun community has already begun to comment on the proposed rule to the tune of about 60,000 responses.&nbsp; If you haven\u2019t already, take the time to write a comment opposing this backdoor gun ban. &nbsp;<\/p>\n\n\n\n<p>Comments matter.&nbsp; As GunsAmerica previously <a href=\"https:\/\/www.gunsamerica.com\/digest\/call-to-action-submit-your-comment-on-atfs-new-frame-or-receiver-rule-today\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"make-millions-of-law-abiding-citizens-felons-overnight-lawmakers-warn-doj-about-brace-ban\" title=\"\u2018Make Millions of Law-Abiding Citizens Felons Overnight,\u2019 Lawmakers Warn DOJ About Brace Ban\">reported<\/a>, good comments can help litigators fight the rule even after it\u2019s been adopted. According to Harvard Law School, comments are crucial for future litigation: \u201cYour comments help create the administrative record that a federal agency or decision-maker has to consider when finalizing a rule or regulation,\u201d the law school points out.<\/p>\n\n\n\n<p>In addition, if government agencies like the ATF fail to adequately consider public comments, a judge may invalidate the rule at a later date. In other words, if they move forward with the rule, they have to show that they\u2019ve adequately addressed the concerns of the public.
