Just a few months after the 10<sup>th<\/sup> Circuit Court <a href=\"https:\/\/www.gunsamerica.com\/digest\/bump-stocks-get-new-life-as-federal-court-agrees-to-rehear-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bump-stocks-live-6th-circuit-rules-devices-are-not-machine-guns\" title=\"Bump Stocks Live! 6th Circuit Rules Devices Are Not Machine Guns\" target=\"_blank\" rel=\"noreferrer noopener\">agreed to rehear a bump stock case<\/a> and the <a href=\"https:\/\/www.gunsamerica.com\/digest\/are-bump-stocks-still-alive-feds-drop-charges-because-they-couldnt-prove-devices-are-machine-guns\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bump-stocks-live-6th-circuit-rules-devices-are-not-machine-guns\" title=\"Bump Stocks Live! 6th Circuit Rules Devices Are Not Machine Guns\" target=\"_blank\" rel=\"noreferrer noopener\">ATF dropped a set of bump stock charges<\/a>, a federal court of appeals has ruled against the ATF\u2019s decision to categorize bump stocks as machine guns.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2021\/03\/BumpStockOp.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"bump-stocks-live-6th-circuit-rules-devices-are-not-machine-guns\" title=\"Bump Stocks Live! 6th Circuit Rules Devices Are Not Machine Guns\" target=\"_blank\" rel=\"noreferrer noopener\">2-1 decision<\/a> was handed down from the United States Court of Appeals for the Sixth Circuit and granted a motion for preliminary injunction filed by Gun Owners of America and the Virginia Citizens Defense League. &nbsp;<\/p>\n\n\n\n<p>Writing for the majority, Senior U.S. Circuit Judge Alice Batchelder argued that the ATF did not have the authority to criminalize millions of bump stock owners and that the agency\u2019s application of the federal machine gun statute is improper.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/watch-as-60000-bump-stocks-are-destroyed\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bump-stocks-live-6th-circuit-rules-devices-are-not-machine-guns\" title=\"Bump Stocks Live! 6th Circuit Rules Devices Are Not Machine Guns\">Watch as 60,000 Bump Stocks Are Destroyed<\/a><\/h2>\n\n\n\n<p>\u201cThere is great risk,\u201d she wrote, \u201cif the responsibility of making moral condemnations is assigned to bureaucrats in the nation\u2019s capital who are physically, and often culturally, distant from the rest of the country. Federal criminal laws are not administrative edicts handed down upon the masses as if the administrators were God delivering the Ten Commandments to Moses on Mount Sinai.\u201d<\/p>\n\n\n\n<p>The ATF had relied on a principle known as the <em>Chevron <\/em>deference doctrine when it made its unilateral decision to reverse course and declare bump stocks machine guns. This doctrine holds that the courts should defer to administrative agencies when a law is unclear as long as that interpretation is reasonable and Congress has not directly spoken on an issue.<\/p>\n\n\n\n<p>But Judge Batchelder pointed out that the <em>Chevron <\/em>doctrine does not apply to criminal statutes. As the Supreme Court ruled in 2014, \u201cwe have&nbsp;<em>never<\/em>&nbsp;held that the government\u2019s reading of a&nbsp;<em>criminal<\/em>&nbsp;statute is entitled to&nbsp;<em>any<\/em>&nbsp;deference.\u201d (Emphasis in original.) Since the ATF\u2019s decision made millions of Americans felons overnight, <em>Chevron <\/em>does not apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/court-rules-no-compensation-companies-destroy-75000-bump-stocks\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bump-stocks-live-6th-circuit-rules-devices-are-not-machine-guns\" title=\"Bump Stocks Live! 6th Circuit Rules Devices Are Not Machine Guns\">Court Rules No Compensation for Companies Forced to Destroy 75,000 Bump Stocks<\/a><\/h2>\n\n\n\n<p>Judge Batchelder also argued that the ATF\u2019s application of the federal machine gun statute is improper. Federal law describes machine guns as those which fire with \u201ca single function of the trigger.\u201d Since the law refers to the trigger and not to the shooter\u2019s trigger finger, bump stocks should not qualify as machine guns.<\/p>\n\n\n\n<p>\u201cA bump stock may change&nbsp;<em>how<\/em>&nbsp;the pull of the trigger is accomplished, but it does not change the fact that the semiautomatic firearm shoots only one shot for each pull of the trigger,\u201d she wrote. \u201cWith or without a bump stock, a semiautomatic firearm is capable of firing only a single shot for each pull of the trigger.\u201d<\/p>\n\n\n\n<p>It\u2019s important to note that the 6<sup>th<\/sup> Circuit\u2019s decision does not by itself reverse the ATF\u2019s interpretation. The three-judge panel of the 6<sup>th<\/sup> Circuit sent the case back to the District Court, which will determine how widespread the injunction will be.
