<\/p>\n\n\n\n

Genderqueers now have the option to check \u201cnon-binary\u201d on Form 4473s<\/a>.<\/p>\n\n\n\n

The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) put out a notice to the public to revise<\/a> the Firearms Transaction Record (4473) in December of 2019.  <\/p>\n\n\n\n

Included in the proposed revision was language to amend Section 14, which asks about the transferee\u2019s sex.  <\/p>\n\n\n\n

Traditionally, there were only two options: \u201cMale\u201d and \u201cFemale.\u201d <\/p>\n\n\n\n

However, “Non-Binary,” a third option, was added to the “Sex” box (Section 14) as part of that latest update. <\/p>\n\n\n\n

Historically, government agencies have resisted adding a non-binary option in order to avoid confusion when trying to identify an individual. <\/p>\n\n\n\n

But in 2017, Oregon became the first state to offer a non-binary option<\/a> on state IDs, and at least nine other states have followed suit. The federal government has joined that trend. <\/p>\n\n\n\n

The change was finalized after the customary 60-day comment period<\/a> from the public, which ran into the early months of 2020. <\/p>\n\n\n\n

Section 14 on current 4473s now reads as follows: <\/p>\n\n\n\n

GunsAmerica is addressing this matter because an older article from 2018, entitled, “Gun Dealers Cannot Transfer Firearms to Genderqueers Who Fail to Check \u2018Male\u2019 or \u2018Female\u2019 on 4473s<\/a>” is still getting legacy traffic due to web searches. <\/p>\n\n\n\n

That headline is no longer correct. <\/p>\n\n\n\n

This new “non-binary” option means that gun dealers can now transfer or sell firearms to individuals who do not identify as either “male” or “female” on the 4473. <\/p>\n\n\n\n
