{"id":142246,"date":"2021-02-23T15:37:51","date_gmt":"2021-02-23T20:37:51","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=142246"},"modified":"2021-02-23T15:37:51","modified_gmt":"2023-08-17T18:42:35","slug":"wa-appeals-court-unanimously-upholds-preemption-in-saf-lawsuit","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/wa-appeals-court-unanimously-upholds-preemption-in-saf-lawsuit\/","title":{"rendered":"WA Appeals Court Unanimously Upholds Preemption in SAF Lawsuit"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p><strong>BELLEVUE, WA \u2013 <\/strong>A Washington State Appeals Court panel has unanimously held that a so-called \u201csafe storage\u201d ordinance adopted by the City of Edmonds and challenged by the Second Amendment Foundation, National Rifle Association and three private citizens violates the state\u2019s 36-year-old model preemption law.<\/p>\n\n\n\n<p>The ruling is a \u201csignificant victory for Evergreen State gun and privacy rights,\u201d said SAF founder and Executive Vice President Alan M. Gottlieb. The case is known as <em><a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2021\/02\/807552-DI-Court-Secured-Opinion-Published-2-22-2021-Andrus-Beth-Majority.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"wa-appeals-court-unanimously-upholds-preemption-in-saf-lawsuit\" title=\"WA Appeals Court Unanimously Upholds Preemption in SAF Lawsuit\">Bass v. City of Edmonds<\/a><\/em>.<\/p>\n\n\n\n<p>\u201cWashington lawmakers wisely adopted state preemption more than 35 years ago, Gottlieb observed. \u201cThe language is clear and unambiguous. Local governments cannot adopt or enforce their own firearms regulations that are more restrictive than state statute. The City of Edmonds knew this when the council adopted the storage requirement.\u201d<\/p>\n\n\n\n<p>The unanimous ruling was written by Acting Chief Judge Beth Andrus, with Judges Bill Bowman and Lori Kay Smith concurring. Writing for the court, Judge Andrus explained, \u201cWe\u2026conclude that the legislature\u2019s express preemption of \u2018the entire field of firearms regulation\u2019 is unambiguous and necessarily extends to regulations of the storage of firearms.\u201d<\/p>\n\n\n\n<p>&nbsp;\u201cLet\u2019s be clear about something,\u201d Gottlieb emphasized. \u201cEdmonds didn\u2019t adopt this safe storage mandate in the interest of safety, but rather to challenge and erode, if not irreparably dismantle the state preemption law. The city has no business dictating to citizens how they should store firearms in their own homes.<\/p>\n\n\n\n<p>\u201cState preemption is the most common sense approach to firearms regulation there is,\u201d he added. \u201cIt provides uniformity on gun laws from one state border to the other. Whether you live in Edmonds or Ephrata, the gun laws are the same.\u201d<\/p>\n\n\n\n<p>SAF and NRA are currently challenging a nearly identical storage ordinance adopted by the City of Seattle prior to time Edmonds adopted its illegal ordinance.
