{"id":138201,"date":"2020-12-03T12:23:47","date_gmt":"2020-12-03T17:23:47","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=138201"},"modified":"2020-12-03T12:23:47","modified_gmt":"2023-09-07T04:02:34","slug":"ex-cop-gets-four-years-for-falsifying-4473s-sending-guns-to-mexico","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/ex-cop-gets-four-years-for-falsifying-4473s-sending-guns-to-mexico\/","title":{"rendered":"Ex-Cop Gets Four Years for Falsifying 4473s, Sending Guns to Mexico"},"content":{"rendered":"\n\n\n\n\n\n\n<p><\/p>\n\n\n\n<p>A former law enforcement officer in Texas will now spend four years behind bars for falsifying 4473s and selling guns to shady characters in Mexico. &nbsp;<\/p>\n\n\n\n<p>Jose Cruz, 49, was sentenced this week to 48 months in prison by U.S. District Judge Randy Crane, reports <a href=\"https:\/\/www.themonitor.com\/2020\/11\/30\/former-gun-store-manager-gets-48-months-weapons-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ex-cop-gets-four-years-for-falsifying-4473s-sending-guns-to-mexico\" title=\"Ex-Cop Gets Four Years for Falsifying 4473s, Sending Guns to Mexico\">The Monitor<\/a>. <\/p>\n\n\n\n<p>According to the criminal complaint, Cruz, while working as the manager of The Gun Rack in McAllen, Texas, sent as many as 80 weapons and at least 500 rounds of ammo south of the border.<\/p>\n\n\n\n<p>Judge Crane said that \u201cAfter a gunfight where there were multiple people killed,\u201d agents from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) were able to trace the recovered guns at the crime scene back to Cruz\u2019s store.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/cz-557-eclipse-just-659\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ex-cop-gets-four-years-for-falsifying-4473s-sending-guns-to-mexico\" title=\"Ex-Cop Gets Four Years for Falsifying 4473s, Sending Guns to Mexico\">New CZ 557 Eclipse \u2014 Just $659!<\/a><\/h2>\n\n\n\n<p>After interviewing Cruz, ATF agents discovered he was padding honest customer\u2019s 4473s with firearms they didn\u2019t purchase.&nbsp; Then, he would sell those extra guns out the back door to individuals to \u201cprotect himself,\u201d according to his statement during the sentencing hearing on Monday. &nbsp;<\/p>\n\n\n\n<p>\u201cHe was basically acting under the direction of other people,\u201d Richard Gould, Cruz\u2019s public defender, said.<\/p>\n\n\n\n<p>It\u2019s not clear who those individuals were or why Cruz didn\u2019t contact law enforcement for help.<\/p>\n\n\n\n<p>As mentioned, Cruz was a cop.&nbsp; He served on the job for 22 years in cities around the area before working as a reserve deputy for the Precinct 3 Hidalgo County Constable\u2019s Office.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"602\" title=\"Ex-Cop Gets Four Years for Falsifying 4473s, Sending Guns to Mexico\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2020\/12\/Screen-Shot-2020-12-03-at-12.14.40-PM-1024x602.png\" alt=\"Ex-Cop Gets Four Years for Falsifying 4473s, Sending Guns to Mexico\" class=\"wp-image-138205\" srcset=\"https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/12\/Screen-Shot-2020-12-03-at-12.14.40-PM-1024x602.png 1024w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/12\/Screen-Shot-2020-12-03-at-12.14.40-PM-400x235.png 400w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/12\/Screen-Shot-2020-12-03-at-12.14.40-PM-150x88.png 150w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/12\/Screen-Shot-2020-12-03-at-12.14.40-PM-768x452.png 768w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/12\/Screen-Shot-2020-12-03-at-12.14.40-PM.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption>Cruz was a well-decorated law enforcement officer with extensive <a href=\"https:\/\/www.krgv.com\/news\/former-hidalgo-co-constable-deputy-charged-with-illegal-weapons-sales\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ex-cop-gets-four-years-for-falsifying-4473s-sending-guns-to-mexico\" title=\"Ex-Cop Gets Four Years for Falsifying 4473s, Sending Guns to Mexico\">training<\/a>, over 1600 hours.  (<em>Photo:<\/em> <em>Valerie Gonzalez<\/em>)  <\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>In court, Cruz asked Judge Crane to consider his public service before deciding on his sentence. &nbsp;<\/p>\n\n\n\n<p>\u201cI\u2019ve already lost a lot of things,\u201d said Cruz, reading from a prepared statement.&nbsp; \u201cI hope that my previous years of helping people out are taken into consideration.\u201d<\/p>\n\n\n\n<p>Judge Crane could have sentenced Cruz up to 57 months in prison.
