{"id":134897,"date":"2020-10-08T11:38:48","date_gmt":"2020-10-08T15:38:48","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=134897"},"modified":"2020-10-08T11:38:48","modified_gmt":"2023-09-07T02:00:58","slug":"grand-jury-indicts-mccloskeys-on-felony-charges","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/grand-jury-indicts-mccloskeys-on-felony-charges\/","title":{"rendered":"Grand Jury Indicts McCloskeys on Felony Charges"},"content":{"rendered":"\n\n\n<p><\/p>\n\n\n\n\n\n\n\n<p><\/p>\n\n\n\n<p><a href=\"https:\/\/www.gunsamerica.com\/mccloskeys-charged-with-felony-for-waving-firearms-at-protesters-gov-vows-to-pardon\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"grand-jury-indicts-mccloskeys-on-felony-charges\" title=\"Grand Jury Indicts McCloskeys on Felony Charges\">The McCloskeys<\/a> were back in the news this week after a grand jury indicted the couple on felony charges.<\/p>\n\n\n\n<p>Mark and Patricia McCloskey now face charges for unlawful use of a weapon and tampering with evidence. &nbsp;<\/p>\n\n\n\n<p>Details about how the grand jury landed on those charges remains unclear as the indictments were filed under seal Tuesday.<\/p>\n\n\n\n<p>\u201cI\u2019ll certainly be interested in what was presented to the grand jury,\u201d said Joel Schwartz, an attorney representing the McCloskeys.&nbsp; Schwartz added that he plans to request a transcript of the proceedings since he wasn\u2019t allowed to be present.<\/p>\n\n\n\n<p>Mark McCloskey slammed the City Counselor\u2019s Office for not pursuing charges against the trespassers and vandals (an iron gate was destroyed) who appeared outside the couple\u2019s home in July. &nbsp;<\/p>\n\n\n\n<p>\u201cThe government chooses to persecute us for doing no more than exercising our right to defend ourselves, our home, our property and our family and now we\u2019re getting drug here time after time after time and for what?\u201d said McCloskey.&nbsp;<\/p>\n\n\n\n<p>\u201cWe didn\u2019t fire a shot,\u201d he continued. \u201cPeople were violently protesting in front of our house and screaming death threats and threats of rape and threats of arson. Nobody gets charged but we get charged.\u201d<\/p>\n\n\n\n<p>City Counselor Michael Garvin had summoned nine people in connection to the protest for trespassing.&nbsp; However, on Sept. 29, Gavin announced that he would not pursue charges against those individuals.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/st-louis-couple-who-defended-themselves-from-blm-protesters-speak-at-2020-rnc\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"grand-jury-indicts-mccloskeys-on-felony-charges\" title=\"Grand Jury Indicts McCloskeys on Felony Charges\">St. Louis Couple Who Defended Themselves from BLM Protesters Speak at 2020 RNC<\/a><\/h2>\n\n\n\n<p>Whether the charges stick in the short term is immaterial as the McCloskeys have the support of both Missouri Attorney General Eric, who has filed a motion to dismiss the case, and Gov. Mike Parson, who has vowed to pardon the couple if they are convicted. &nbsp;<\/p>\n\n\n\n<p>Still, many view it as a matter of principle.&nbsp; Supporters believe the McCloskeys acted within the purview of state law and the Constitution when they confronted trespassers with an AR-15 and a non-operating pistol outside their home in St. Louis last July.&nbsp;<\/p>\n\n\n\n<p>One additional wrinkle to the state\u2019s case is that according to Al Watkins, another attorney representing the duo, prosecutors allegedly fixed the handgun held by Patricia McCloskey so that it could fire off a round.&nbsp;<\/p>\n\n\n\n<p>Why prosecutors would tamper with evidence is unclear.&nbsp; But Watkins was miffed.&nbsp;<\/p>\n\n\n\n<p>&#8220;This is b&#8212;&#8212;t,&#8221; Watkins told <a href=\"https:\/\/www.foxnews.com\/us\/mccloskeys-indicted-on-charges-of-unlawful-use-of-a-weapon-and-tampering-with-evidence.amp\" target=\"_blank\" class=\"clickTracking\" campaign=\"grand-jury-indicts-mccloskeys-on-felony-charges\" title=\"Grand Jury Indicts McCloskeys on Felony Charges\">Fox News<\/a>. &#8220;Hate to say it, but the state has a lot of problems with this one.
