Attorney General Karl Racine announced yesterday a lawsuit filed by his office against the 80 percent receiver company, Polymer80.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/oag.dc.gov\/sites\/default\/files\/2020-06\/Polymer80-Complaint.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"washington-d-c-sues-polymer80\" title=\"Washington, D.C., Sues Polymer80 for Illegally Selling 'Ghost Guns' to District Residents\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"suit (opens in a new tab)\">suit<\/a> alleges that Polymer80 falsely claims its \u201cfirearms\u201d are legal in the District, fails to disclose that it is not licensed to sell firearms in the District, and sells \u201cfirearms\u201d that violate \u201cnumerous\u201d of the District\u2019s gun control laws. <\/p>\n\n\n\n<p>\u201cPolymer80 makes it easy for individuals to buy unmarked and\nuntraceable firearms that are commonly used to commit violent crimes,\u201d Racine\nsaid in a statement. \u201cIndeed, Polymer80\u2019s guns have been used in several\nhomicides in the District. The Office of the Attorney General is seeking a\ncourt order to stop the company from selling ghost guns to D.C. consumers and to\nget these deadly weapons off our streets.\u201d<\/p>\n\n\n\n<p>Polymer80 sells what are commonly referred to as receiver \u201cblanks\u201d\nfor both rifles and handguns. The Bureau of Alcohol, Tobacco, and Firearms has <a href=\"https:\/\/www.polymer80.com\/media\/wysiwyg\/porto\/LegalDocs\/P80_Product_Determination_Letters.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"washington-d-c-sues-polymer80\" title=\"Washington, D.C., Sues Polymer80 for Illegally Selling 'Ghost Guns' to District Residents\">concluded<\/a>\nthat these products do not constitute firearms or firearm receivers because\nthey are less than 80 percent complete and require the use of special tools and\nexpertise to complete. <\/p>\n\n\n\n<p>But Racine and other leaders in D.C. see Polymer80\u2019s\nproducts as a threat to public health. A statement from Racine\u2019s office claims\nthat of the 250 non-serialized firearms recovered by law enforcement since\n2017, over 80 percent were manufactured by Polymer80, including guns \u201clinked\u201d\nto nine homicides. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/modular-glock-gst-9-80-percent-arms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"washington-d-c-sues-polymer80\" title=\"Washington, D.C., Sues Polymer80 for Illegally Selling 'Ghost Guns' to District Residents\">The World\u2019s First Truly Modular 80% Glock: The GST-9 By 80 Percent Arms<\/a> <\/h2>\n\n\n\n<p>Racine\u2019s lawsuit claims the company misleads consumers in\nthe District because the Polymer80 website does not inform District residents\nthat their products are illegal in D.C. The suit includes a screenshot of the Polymer80\nwebsite\u2019s homepage, which asks the rhetorical question, \u201cIs it legal?\u201d and\nresponds \u201cYes!\u201d<\/p>\n\n\n\n<p>But the suit fails to acknowledge the text that comes after\nthe, \u201cYes!\u201d Polymer80 notes that their product is legal under federal law, but\nit says nothing about state or District law.<\/p>\n\n\n\n<p>Racine also argues that Polymer80 violates District gun\ncontrol laws by selling its product to D.C. consumers. Polymer80 has broken a\nlaw that requires firearm dealers to impose a 10-day waiting period as well as\na law that all firearms be inscribed with a serial number, according to the\nsuit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/rhode-island-bans-ghost-guns-w-10-year-prison-sentence-for-violators\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"washington-d-c-sues-polymer80\" title=\"Washington, D.C., Sues Polymer80 for Illegally Selling 'Ghost Guns' to District Residents\">Rhode Island Bans \u2018Ghost Guns\u2019 w\/ 10 Year Prison Sentence for Violators<\/a> <\/h2>\n\n\n\n<p>Finally, Racine claims that Polymer80 fails to disclose that\nit is not licensed to sell firearms in the District or that consumers must\nregister their firearms.<\/p>\n\n\n\n<p>\u201cTo legally sell firearms in the District, merchants must\nobtain a commercial license.
