Last week Boyce shot a man she believed was trying to rob her store.  Local police are now charging the octogenarian with aggravated assault. <\/p>\n\n\n\n

In talking with media, Boyce believes she acted within the law to defend herself and her property. <\/p>\n\n\n\n

\u201cI did what I had to do, and I hope word gets out on the street that I\u2019m fed up and I\u2019m not taking it anymore,\u201d she told The New York Post<\/a> on Saturday, when she returned to work after being released from jail on a $10,000 bond.  <\/p>\n\n\n\n

\u201cYou\u2019ve got to stick up for yourself sometimes,\u201d she added.  <\/p>\n\n\n\n

Authorities, on the other hand, tell a different story, according to an affidavit obtained by the McClatchy News Service<\/a>.\u00a0 The man Boyce shot, identified as Ramon Fisher, initially told police that he was high on cocaine and alcohol when he entered the store with the intent to steal some bottles.\u00a0 Fisher was accompanied by a buddy.<\/p>\n\n\n\n

However, the next day, Fisher recanted, telling investigators that he and his friend planned to pay for the booze after all. No charges have been filed against those two “customers.” <\/p>\n\n\n\n

But, it looks as though prosecutors believe they have enough evidence to hold Boyce criminally liable. \u00a0Hence the charge she’s facing for aggravated assault. <\/p>\n\n\n\n

Boyce maintains she was being physically threatened by the two men and that she didn\u2019t intend to actually harm either one when she produced her late mother Mary\u2019s .38 caliber Smith & Wesson snub-nose revolver.<\/p>\n\n\n\n

\u201cI never shot a gun before,\u201d Boyce admitted, \u201cbut I guess it\u2019s something that comes natural. I aimed at the floor to scare him.\u201d<\/p>\n\n\n\n

Boyce, a widow who stands 5\u20193\u2033 and weighs 115 pounds, told WSFA12<\/a> that this is not the first time she\u2019s had to fend off would-be thieves over her 26 years in business. <\/p>\n\n\n\n

In fact, the latest incident happened just days before the confrontation with Mr. Fisher.\u00a0 Two individuals tried to steal an entire case of liquor.\u00a0 Boyce pursed the thieves with a club. \u00a0<\/p>\n\n\n\n

\u201cI was going to break it before, you know. I\u2019d let them have it, I thought, but instead they just knocked me down outside,\u201d Boyce explained.<\/p>\n\n\n\n

All in all, it appears this little lady is tired of being a target.  <\/p>\n\n\n\n

\u201cAfter you\u2019ve been played for a fool by people stealin\u2019 from you for years, you get fed up. And don\u2019t put me in the category of a little old lady. I know how to take care of myself.\u201d<\/p>\n\n\n\n

Though she\u2019s no longer scared to engage criminals, moving forward she\u2019s going to do so without her gun.\u00a0 Police confiscated it and told her it may take up to two years before it’s returned.\u00a0<\/p>\n\n\n\n

\u201cI told \u2019em, s\u2013t, I might be dead by then,\u201d Boyce told the New York Post. \u201cBut the law\u2019s the law.\u201d<\/p>\n\n\n\n\n\n\n\n
