SCOTUS has once again punted on several Second Amendment cases. <\/em><\/figcaption><\/figure>\n\n\n\n

<\/p>\n\n\n\n

The United States Supreme Court announced today its decision to deny certiorari to several gun-related cases that gun rights advocates had hoped would clarify state restrictions on concealed carry, semi-automatic firearms, and magazine capacity.<\/p>\n\n\n\n

The decision is a major blow for the pro-2A movement. Groups\nlike the Second Amendment Foundation had hoped the Court would take one of\nthese cases after it threw out a gun-related case from New York earlier this\nyear. President Trump\u2019s appointment of Neil Gorsuch and Brett Kavanaugh also gave\n2A groups reason to hope that the court would break its decade-long silence on\nSecond Amendment issues. <\/p>\n\n\n\n

But in its orders published today<\/a>, the justices left in place restrictions on the right to carry firearms in public in Maryland, Massachusetts and New Jersey. They also declined to review Massachusetts\u2019 ban on \u201cassault weapons\u201d and ammunition magazines, a California handgun control law, and a federal law banning interstate handgun sales.<\/p>\n\n\n\n

\u201cGiven the fact that the Supreme Court had a cafeteria-style\nmenu of cases from which to choose, there is no excuse why the court at this\ntime chose to ignore the need to rule on any of these cases, and send a message\nto lower courts that they can no longer thumb their noses at the Heller<\/em>\nand McDonald<\/em> Supreme Court decisions affirming the right to keep and\nbear arms,\u201d said Alan Gottlieb, founder and executive vice president of the\nSecond Amendment Foundation (SAF).<\/p>\n\n\n\n

Justices Clarence Thomas and Neil Gorsuch wrote a dissent\ndisagreeing with the Court\u2019s decision to deny certiorari to a concealed carry\ncase out of New Jersey. <\/p>\n\n\n\n

Thomas, who has been the court\u2019s most vocal critic of its\nsilence on Second Amendment issues, pointed out that the lower courts have \u201csystematically\nignored\u201d the Court\u2019s holding in its landmark 2008 case, D.C. v. Heller<\/em>. That\ncase supposedly solidified the individual right to keep and bear arms, but\nlower courts have subsequently ignored or reinterpreted the Court\u2019s ruling.<\/p>\n\n\n\n

Rather than addressing these discrepancies, \u201cthe Court\nsimply looks the other way,\u201d Thomas says.<\/p>\n\n\n\n

Thomas argues that the Court would immediately take up a\ncase in which a state required a \u201cgood cause\u201d to exercise First Amendment\nrights or to procure an abortion, as New Jersey does to exercise the right to\nbear arms. <\/p>\n\n\n\n

\u201cIn several jurisdictions throughout the country,\nlaw-abiding citizens have been barred from exercising the fundamental right to\nbear arms because they cannot show that they have a \u2018justifiable need\u2019 or \u2018good\nreason\u2019 for doing so. One would think that such an onerous burden on a\nfundamental right would warrant this Court\u2019s review,\u201d Thomas says.<\/p>\n\n\n\n

\u201cWith what other constitutional right would this Court allow such blatant defiance of its precedent? Whatever one may think about the proper approach to analyzing Second Amendment challenges, it is clearly time for us to resolve this issue\u201d he adds.<\/p>\n\n\n\n

The lower courts are split when it comes to many Second Amendment issues. Thomas points out, for example, that the D.C. Circuit Court has struck down \u201cgood cause\u201d requirements for concealed carry while the First, Second, Third, and Fourth Circuits have upheld such licensing schemes. <\/p>\n\n\n\n

Analysts have wondered for years why the court has refused to step in and settle these disputes. The prevailing theory is that Chief Justice John Roberts has refused to indicate whether he would uphold gun rights in any particular case. Without the assurance of a fifth vote, the four justices on the unofficial \u201cconservative\u201d block are hesitant to take a case and risk a loss. <\/p>\n\n\n\n

If, for example, Roberts sided with the progressive block\nand upheld a state\u2019s \u201cgood cause\u201d requirement, there would be no stopping any\nstate from implementing a similar licensing requirement. <\/p>\n\n\n\n

\u201cThe Supreme Court\u2019s refusal to take a Second Amendment\nFoundation case falls squarely at the feet of Chief Justice John Roberts,\u201d\nGottlieb said. \u201cHe owes every gun owner in the United States an explanation\nabout why the high court declined to hear a number of important Second\nAmendment cases.\u201d<\/p>\n\n\n\n

There is still one more case pending cert before the high court that was filed by the SAF. It is known a Rodriguez v. San Jose<\/em>, a firearms confiscation case out of the State of California. <\/p>\n\n\n\n
