{"id":129836,"date":"2020-06-08T15:34:13","date_gmt":"2020-06-08T19:34:13","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=129836"},"modified":"2020-06-08T15:34:13","modified_gmt":"2023-09-05T23:29:56","slug":"florida-supreme-court-throws-out-assault-weapon-ban-ballot","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/florida-supreme-court-throws-out-assault-weapon-ban-ballot\/","title":{"rendered":"Florida Supreme Court Throws Out &#8216;Assault Weapon&#8217; Ban Ballot Initiative"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1000\" height=\"600\" title=\"Florida Supreme Court Throws Out 'Assault Weapon' Ban Ballot Initiative\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/hogg-bawn.gif\" alt=\"Florida Supreme Court Throws Out 'Assault Weapon' Ban Ballot Initiative\" class=\"wp-image-111201\" \/><figcaption><em>David Hogg is the &#8220;Chief Organizing Coordinator&#8221; behind the effort to ban &#8220;assault weapons&#8221; in Florida (Photo: BAWN Youtube)<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The Florida Supreme Court has thrown out a ballot initiative that would have enshrined in the state constitution a ban on some kinds of semi-automatic firearms. <\/p>\n\n\n\n<p>In a 4-1 <a href=\"https:\/\/www.floridasupremecourt.org\/content\/download\/637052\/7237090\/file\/sc19-1266.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-supreme-court-throws-out-assault-weapon-ban-ballot\" title=\"Florida Supreme Court Throws Out 'Assault Weapon' Ban Ballot Initiative\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"decision (opens in a new tab)\">decision<\/a>, the court ruled that the initiative was defective because the summary of the amendment used unclear language that contradicted the text of the amendment.<\/p>\n\n\n\n<p>The summary indicated that weapons possessed prior to the\ninitiative would be exempt from the ban, which would have allowed those\nfirearms to be transferred to another person. The actual text of the amendment,\nhowever, only allowed the owner of the weapon to be exempt. <\/p>\n\n\n\n<p>\u201cWhile the ballot summary purports to exempt registered\nassault weapons lawfully possessed prior to the initiative\u2019s effective date,\nthe initiative does not categorically exempt the assault weapon, only the current\nowner\u2019s possession of that assault weapon,&#8221; the majority wrote. &#8220;The\nballot summary is therefore affirmatively misleading.\u201d<\/p>\n\n\n\n<p>The ballot initiative was written and promoted by a group called <a href=\"https:\/\/bawnfl.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-supreme-court-throws-out-assault-weapon-ban-ballot\" title=\"Florida Supreme Court Throws Out 'Assault Weapon' Ban Ballot Initiative\">Ban Assault Weapons Now (BAWN)<\/a>. They\u2019re seeking to garner the 766,200 petition signatures necessary to get their \u201cassault weapons\u201d ban on the list of measures voters can consider for ratification in the state constitution.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/florida-attorney-general-far-reaching-misleading\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-supreme-court-throws-out-assault-weapon-ban-ballot\" title=\"Florida Supreme Court Throws Out 'Assault Weapon' Ban Ballot Initiative\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Florida Attorney General Calls Proposed Assault Weapon Ban \u2018Far-Reaching\u2019 and \u2018Misleading\u2019 (opens in a new tab)\">Florida Attorney General Calls Proposed Assault Weapon Ban \u2018Far-Reaching\u2019 and \u2018Misleading\u2019<\/a><\/h2>\n\n\n\n<p>But <a href=\"https:\/\/www.politico.com\/states\/florida\/story\/2020\/06\/04\/after-parkland-florida-court-rejects-ban-on-semi-automatic-rifles-1290878\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-supreme-court-throws-out-assault-weapon-ban-ballot\" title=\"Florida Supreme Court Throws Out 'Assault Weapon' Ban Ballot Initiative\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Politico<\/a> reported last week that the group has only garnered about 175,000 signatures, a 75,000 increase since GunsAmerica <a href=\"https:\/\/www.gunsamerica.com\/florida-assault-weapons-ban-100000-signatures\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-supreme-court-throws-out-assault-weapon-ban-ballot\" title=\"Florida Supreme Court Throws Out 'Assault Weapon' Ban Ballot Initiative\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">reported<\/a> in June of last year that BAWN had broken the 100,000 mark. At 75,000 signatures per year, it will take the group more than a decade to reach the necessary threshold.<\/p>\n\n\n\n<p>That isn\u2019t stopping the group from continuing its push. <\/p>\n\n\n\n<p>\u201cThe Supreme Court, now controlled by the NRA in the same\nway as our Governor and our Legislature, has fundamentally failed the people of\nFlorida,\u201d BAWN Chair Gail Schwartz said in a statement. \u201cNot only has the\nLegislature recently made it harder to pass ballot initiatives, now the people\nmust also face a court of rightwing ideologues who will only approve\ninitiatives they agree with politically.\u201d<\/p>\n\n\n\n<p>&#8220;The Supreme Court\u2019s rejection of BAWN\u2019s amendment does not change our commitment to rid Florida of these killing machines,&#8221; Schwartz said. &#8220;After striving for two years for a safer state for our families, we\u2019re just getting started.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/assault-weapon-ban-florida\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"florida-supreme-court-throws-out-assault-weapon-ban-ballot\" title=\"Florida Supreme Court Throws Out 'Assault Weapon' Ban Ballot Initiative\">\u2018Assault Weapon\u2019 Ban in Florida\u2026 Anti-Gun Groups Join Forces to Put it on the Ballot<\/a><\/h2>\n\n\n\n<p>Schwartz is the aunt of one of the victims of the Parkland massacre. The group also lists David Hogg as its &#8220;Chief Organizing Coordinator.&#8221;<\/p>\n\n\n\n<p>Gun rights groups applauded the ruling, including the\nNational Shooting Sports Foundation (NSSF), which submitted a brief opposing\nthe ban.<\/p>\n\n\n\n<p>\u201cOn behalf of our industry members in Florida we are thankful the Florida Supreme Court rejected the Mayor Bloomberg-funded deceptive and misleading effort ballot initiative to ban state-wide the lawful sale of virtually all semi-automatic rifles and shotguns in the state to law abiding Floridians after of background check,\u201d said Lawrence G.
