The debate is heating up around a concealed carry case currently before the Supreme Court. <\/em><\/figcaption><\/figure>\n\n\n\n

<\/p>\n\n\n\n

Can a state deny residents of other states the right to carry concealed firearms within its borders?<\/p>\n\n\n\n

According to one legal scholar, the answer is yes.<\/p>\n\n\n\n

Arnold Loewy is the George Killam Professor of Law at Texas Tech School of Law, and he argued in an op-ed published over the weekend in Lubbock Online<\/a> that Illinois has every right to prohibit residents from other states from carrying concealed.<\/p>\n\n\n\n

\u201cIn recent years, perhaps in part due to judicial expansion\nof the Second Amendment, the number of horrific mass murders has risen\nexponentially,\u201d he says. \u201cIllinois attempted to do just that with the statute\nwe are debating.\u201d<\/p>\n\n\n\n

The debate has been heating up in recent weeks in response to several gun rights cases in the petition docket at the U.S. Supreme Court. In Culp v. Raoul<\/a>, petitioners are asking the court to decide whether Illinois has the right to deny permits to non-residents, and some observers thought<\/a> the court might announce today their intention to grant this or another gun case. So far no decision has been reached, but the court is scheduled<\/a> to conference again this Thursday to vote on which new cases to take. <\/p>\n\n\n\n

Only residents of Texas, Arkansas, Mississippi, and Virginia\nwho already possess concealed carry licenses may apply for the same kind of license\nin Illinois. Residents of all other 45 states are prohibited from even\nattempting to secure a license.<\/p>\n\n\n\n

The reason, Loewy explains, is that Illinois officials want\nto protect their ability to monitor for criminal history and mental illness.\nThey have determined that only four states have licensing schemes sufficient to\nuphold their standards. <\/p>\n\n\n\n

\u201cIt is true that a duly licensed resident of Oklahoma may\nnot be able to obtain a concealed carry license even if he is totally sane and\nlacking any criminal record,\u201d Loewy says. \u201cAnd why is that? It is because such\nan individual may at some point commit a serious violent crime or become\nmentally incapacitated and Illinois would have no way of knowing that because\napparently Oklahoma\u2019s monitoring system does not meet Illinois\u2019 standard.\u201d<\/p>\n\n\n\n

Loewy points out that Illinois allows residents of other\nstates to carry a firearm in their car or in a home with the permission of a\nhomeowner.<\/p>\n\n\n\n

\u201cIt is reasonable to ensure the safety of the entire\npopulace that a person from a state with less stringent registration laws than\nIllinois, not be permitted to carry a concealed weapon therein. Given the\nconcessions made to non-residents of allowing guns to be kept in cars and\nprivate homes, I think the legislation is reasonable and should be sustained,\u201d\nhe concludes. <\/p>\n\n\n\n

In contrast to Loewy, attorney Charles Moster argued in the\nsame op-ed that Illinois\u2019 scheme is unconstitutional. It restricts Second\nAmendment rights, Moster points out, and it introduces a troubling precedent\nfor other restrictions. <\/p>\n\n\n\n

\u201cSuch rationale opens a constitutional Pandora\u2019s Box which\nwould allow identical actions by other states,\u201d he says. \u201cIn such situation,\nany restriction would be fair game. The resultant slippery slope is a fast\ntrack to the ultimate confiscation of guns, which historically paves the way to\nauthoritarian control and the end of democracy.\u201d<\/p>\n\n\n\n

Moster also cited an amicus brief filed in Culp v. Raoul by\neighteen states attorneys general.<\/p>\n\n\n\n

\u201cThe right to concealed carry is denied, in a discriminatory and arbitrary manner, to the law-abiding and qualified persons in 45 states, who are prohibited from even applying for an Illinois concealed carry license (\u201cCCL\u201d) regardless of their qualifications,\u201d the brife states. \u201cTherefore, the Illinois prohibition on virtually all non-residents obtaining a concealed carry license for self-defense violates the Petitioner\u2019s rights under the Second Amendment.\u201d<\/p>\n\n\n\n
