A state-level commissioner in Florida is being sued after her department unilaterally closed online applications for concealed carry permits.<\/p>\n\n\n\n

Commissioner of Agriculture and Consumer Services Nikki\nFried shut down the state\u2019s application process last month \u201cdue to coronavirus\nprecautions.\u201d But President of Young Americans for Liberty Cliff Maloney argues\nin a new lawsuit that Fried has no legitimate reason to close the online form. <\/p>\n\n\n\n

\u201cIt\u2019s truly sad to see Nikki Fried exploiting the COVID-19 crisis to further her anti-Second Amendment agenda,\u201d Maloney told The Washington Times<\/a><\/em>. \u201cShe can host an online fundraiser for Joe Biden, but she can\u2019t accept online applications for concealed weapons licenses? Commissioner Fried needs to stop infringing on the constitutional right of Floridians to protect themselves and their families.\u201d<\/p>\n\n\n\n

The Agriculture Department argues that it paused online applications to prevent people from losing their application fee after submitting incomplete applications, according to WEAR TV<\/a>. Since many police stations are closed due to the COVID-19 crisis, department officials worry that applicants will submit their forms without the necessary fingerprints. <\/p>\n\n\n\n

They also argue that they\u2019re still accepting paper applications and have completed 54,000 since March 1. <\/p>\n\n\n\n

But Florida Attorney General Ashely Moody noted in a letter to Fried<\/a> that their concerns about fingerprinting would still apply to those who submit paper applications.<\/p>\n\n\n\n

\u201cI understand that it is likely more difficult for Floridians\nto obtain fingerprints. But, those difficulties would equally exist for mailed\nin applications, which your agency purports to still be accepting,\u201d Moody said.\n<\/p>\n\n\n\n

Maloney has also pointed out that the Department of\nAgriculture is still accepting hemp cultivation applications online, which require\nfingerprints.<\/p>\n\n\n\n

\u201cWe are just trying to make sure that every single person in\nthe State of Florida has the right to defend themselves and has the right to\ndefend their family, something Nikki Fried does not have the right to dictate,\u201d\nMaloney told WEAR TV.<\/p>\n\n\n\n

A spokesperson from the Department of Agriculture issued a\nstatement to WEAR TV arguing that their actions are in the best interest of\nFloridians.<\/p>\n\n\n\n

\u201cThis action is consistent with state law and is in the\ninterest of Floridians seeking concealed weapons licenses \u2014 anyone who wants to\napply can submit applications with fingerprint cards from a law enforcement\nagency by mail or through tax collector offices, as normal,\u201d the department\nsaid. <\/p>\n\n\n\n

Fried is Florida\u2019s only statewide elected Democrat, and she\nhasn\u2019t been shy about her anti-gun stance since she gained the seat. In December\nof last year, she filed a brief backing the ability of cities and counties to\nissue their own gun control regulations.<\/p>\n\n\n\n

\u201cThe out-of-touch NRA simply can\u2019t handle that they\u2019ve lost control, they\u2019ve lost in court, and they\u2019ve lost revenue made at the expense of communities demanding common-sense gun safety,\u201d she said at the time<\/a>. \u201cDespite the improved efficiency and accountability we\u2019ve brought to concealed weapons licensing \u2014 including up to a 98 percent cut in review times \u2014 the NRA can attack me all they want. They can\u2019t stop me from fighting to keep Florida\u2019s families safe from gun violence.\u201d<\/p>\n\n\n\n
