Baker<\/a><\/em>, argued that Gov. Charlie Baker&#8217;s emergency order shuttering FFLs statewide eliminated \u201call lawful channels of access to constitutionally protected arms and ammunition by mandating the closure of all businesses that sell firearms and ammunition to the consumer public. These actions amount to a ban on obtaining modern arms for personal defense in the Commonwealth of Massachusetts.\u201d<\/p>\n\n\n\n<p>Those plaintiffs included the Second Amendment Foundation (SAF), Firearms Policy Coalition, and Commonwealth Second Amendment, Inc. <\/p>\n\n\n\n<p>\u201cWe are delighted at the decision by U.S. District Judge Douglas P. Woodlock and the swiftness with which it was reached,\u201d said SAF founder and Executive Vice President Alan M. Gottlieb. <\/p>\n\n\n\n<p>\u201cConstitutional rights are never put on hold because of an emergency, including the outbreak of a virus. Too many elected officials think otherwise, and we\u2019re having to deal with them one lawsuit a time, same as we\u2019re taking on Governor Baker,&#8221; Gottlieb continued. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a href=\"https:\/\/www.gunsamerica.com\/poll-70-percent-of-americans-say-gun-stores-should-be-closed\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-scores-big-win-massachusetts-gun-shops-to-reopen\" title=\"SAF Scores Big Win: Massachusetts Gun Shops to Reopen\">Poll: 70 Percent of Americans Say Gun Stores Should Be Closed<\/a><\/h2>\n\n\n\n<p>Judge Woodlock in his decision said &#8220;There was no justification here&#8221; for forcing the gun shops to close.  He further noted that store owners can get back to business starting at noon this Saturday, May 9.  <\/p>\n\n\n\n<p>\u201cWhen Governor\nBaker lumped gun shops in with thousands of other businesses deemed\n\u2018non-essential,\u2019 he obviously didn\u2019t consider the exercise of a fundamental\nright to be essential,\u201d Gottlieb observed. \u201cWe can think of nothing that is\nmore essential than exercising a right protected by the Constitution,\nespecially during a declared state of emergency. <\/p>\n\n\n\n<p>\u201cGun shops in other states have remained open,\u201d Gottlieb added, \u201cand those stores have come up with creative strategies to serve the public without endangering anyone. We\u2019re confident Massachusetts retailers will be equally ingenious in their compliance with social distancing and sanitation requirements. We will continue pressing these cases wherever they\u2019ve shown up because we\u2019re not just talking about business here, we\u2019re talking about rights.\u201d\u00a0 <\/p>\n\n\n\n<p>As GunsAmerica previously <a href=\"https:\/\/www.gunsamerica.com\/poll-70-percent-of-americans-say-gun-stores-should-be-closed\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-scores-big-win-massachusetts-gun-shops-to-reopen\" title=\"SAF Scores Big Win: Massachusetts Gun Shops to Reopen\">reported<\/a> there were only four remaining states that had continued to close FFLs under emergency orders: New York, Massachusetts, Michigan and Washington.  <\/p>\n\n\n\n<p>With Massachusetts now set to reopen its stores, only three remain.  No doubt SAF is hard at work to ensure these holdouts fall in line.
