A district attorney has announced simultaneously that the case will appear before a grand jury. <\/p>\n\n\n\n<p>The incident involved 25-year-old Ahmaud Arbery, who was jogging down a neighborhood street on February 23 in the town of Brunswick. He was shot and killed while struggling for a shotgun held by 34-year-old Travis McMichael. <\/p>\n\n\n\n<p>Travis and his father, Gregory, 64, were allegedly following\nArbery because they suspected that the 25-year-old was involved in a string of\nrobberies in the neighborhood. <\/p>\n\n\n\n<p>&#8220;Travis, the guy is running down the street, let&#8217;s\ngo,&#8221; Gregory McMichael said, according to a police report.<\/p>\n\n\n\n<p>Travis grabbed a shotgun while Gregory grabbed a handgun,\nand they soon caught up to Arbery.<\/p>\n\n\n\n<p>&#8220;Stop, stop, we want to talk to you,&#8221; Gregory\nMcMichael shouted at Arbery, according to the police report.<\/p>\n\n\n\n<p>It isn\u2019t clear from the video how much interaction had already occurred between the three men before the footage begins. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/employee-jailed-after-shooting\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"video-emerges-showing-shooting-of-unarmed-black-man-in-georgia-grand-jury-formed\" title=\"Video Emerges Showing Shooting of Unarmed Black Man in Georgia, Grand Jury Formed\">Employee Jailed After Shooting Would-Be Thief Who Broke into His Store<\/a> <\/h2>\n\n\n\n<p>Arbery can be seen running in a white t-shirt while the McMichaels wait for him farther down the road. The police report indicates that prior to this point, the McMichaels had already tried to cut Arbery off, and he had turned around and run in the opposite direction, according to <a href=\"https:\/\/www.cnn.com\/2020\/05\/05\/us\/ahmaud-arbery-jogging-georgia-shooting\/index.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"video-emerges-showing-shooting-of-unarmed-black-man-in-georgia-grand-jury-formed\" title=\"Video Emerges Showing Shooting of Unarmed Black Man in Georgia, Grand Jury Formed\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">CNN<\/a>.<\/p>\n\n\n\n<p>In the video, Travis McMichael can be seen standing beside\nthe driver\u2019s side of the truck while his father stands in the bed of the truck.\nArbery runs around the right side of the truck and comes around the front\ntowards Travis McMichael. <\/p>\n\n\n\n<p>The two appear to struggle for the shotgun, and a shot can\nbe heard right before Arbery begins striking Travis McMichael. A second shot is\nfired off camera, and when the two appear back on the screen, Arbery strikes McMichael\nseveral more times while a third shot is fired. <\/p>\n\n\n\n<p>Arbery sustained three wounds and died shortly thereafter. <\/p>\n\n\n\n<p>The first two prosecutors on this case recused themselves\nover possible conflicts of interest. Gregory McMichael is a former police\nofficer as well as a former investigator for the district attorney in the\nBrunswick Judicial Circuit.<\/p>\n\n\n\n<p>One of those prosecutors, George E. Barnhill, refused to prosecute the two men because Arbery\u2019s attempt to grab Travis McMichael\u2019s gun justifies deadly force under Georgia law, according to the <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.nytimes.com\/2020\/04\/26\/us\/ahmed-arbery-shooting-georgia.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"video-emerges-showing-shooting-of-unarmed-black-man-in-georgia-grand-jury-formed\" title=\"Video Emerges Showing Shooting of Unarmed Black Man in Georgia, Grand Jury Formed\" target=\"_blank\">New York Times<\/a>. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/poll-70-percent-of-americans-say-gun-stores-should-be-closed\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"video-emerges-showing-shooting-of-unarmed-black-man-in-georgia-grand-jury-formed\" title=\"Video Emerges Showing Shooting of Unarmed Black Man in Georgia, Grand Jury Formed\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Poll: 70 Percent of Americans Say Gun Stores Should Be Closed (opens in a new tab)\">Poll: 70 Percent of Americans Say Gun Stores Should Be Closed<\/a><\/h2>\n\n\n\n<p>Barnhill also contended that the father and son acted within\nthe scope of Georgia\u2019s citizen\u2019s arrest statute.<\/p>\n\n\n\n<p>Barnhill pointed to a 911 call that took place moments\nbefore the chase began in which a neighbor told a dispatcher that a black man\nin a white T-shirt was inside a house that was under construction and only\npartially closed in.<\/p>\n\n\n\n<p>\u201cAnd he\u2019s running right now,\u201d the man told the dispatcher.\n\u201cThere he goes right now!\u201d<\/p>\n\n\n\n<p>S. Lee Merritt, an attorney for the Arbery family, disagrees with Barnhill\u2019s assessment. At best, the men had the authority to follow Arbery and send law enforcement to that location, Merritt told <a href=\"https:\/\/www.cnn.com\/2020\/05\/05\/us\/ahmaud-arbery-jogging-georgia-shooting\/index.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"video-emerges-showing-shooting-of-unarmed-black-man-in-georgia-grand-jury-formed\" title=\"Video Emerges Showing Shooting of Unarmed Black Man in Georgia, Grand Jury Formed\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">CNN<\/a>.<\/p>\n\n\n\n<p>&#8220;According to that law, you actually have to be\nobserving the crime or be in the immediate knowledge of the crime,&#8221;\nMerritt said. &#8220;The only thing they have ever said is &#8230; that Ahmaud\nstopped by a house that was under construction and he looked through the\nwindow. We don&#8217;t know if that happened or not, but even if that did happen that\nis not a felony that would invoke the citizen&#8217;s arrest statute that would make\nthis allowable.&#8221;<\/p>\n\n\n\n<p>The new district attorney, Tom Durden, believes the case deserves to be heard before a grand jury, which will determine whether to indict either of the McMichaels for their actions.
