One federal judge thinks so.<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>A federal judge in Nevada has allowed a lawsuit to move forward that alleges semi-automatic AR-15s should be considered machine guns because they can be converted to simulate fully automatic fire using bump stocks. <\/p>\n\n\n\n<p>The suit is being brought against several gun makers and\ndealers, including Colt and Daniel Defense, by the family of a woman killed in\nthe Las Vegas massacre in 2017. <\/p>\n\n\n\n<p>The Parsons family and their attorneys asserted three causes\nof action, two of which were dismissed by U.S. District Judge Andrew Gordon.\nBut Judge Gordon allowed the suit to move forward based on the plaintiff\u2019s\nwrongful death claim, arguing that the federal Protection of Lawful Commerce in\nArms Act (PLCAA) does not bar the suit from continuing. <\/p>\n\n\n\n<p>The case will next be considered by the Nevada Supreme\nCourt. <\/p>\n\n\n\n<p>\u201cWe\u2019re pleased that Judge Gordon certified these questions\nto the Nevada Supreme Court. We\u2019re optimistic that the Supreme Court is not\ngoing to rule that the legislature intended to give immunity to companies that\nintentionally violate the law,\u201d <a href=\"https:\/\/www.courthousenews.com\/gun-makers-must-face-a-familys-wrongful-death-claims-in-las-vegas-shooting-dispute\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-judge-ar-15s-machine-guns\" title=\"Nevada Judge Allows Suit to Move Forward Alleging AR-15s Should be Considered Machine Guns\">said<\/a>\none of the Parsons family attorneys, Rich Friedman.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/court-rules-no-compensation-companies-destroy-75000-bump-stocks\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-judge-ar-15s-machine-guns\" title=\"Nevada Judge Allows Suit to Move Forward Alleging AR-15s Should be Considered Machine Guns\">Court Rules No Compensation for Companies Forced to Destroy 75,000 Bump Stocks<\/a> <\/h2>\n\n\n\n<p>The Parsons argue that gun makers should be held accountable\nfor their daughter\u2019s death because they should have foreseen that someone could\nhave modified their rifles with bump stocks to turn them into machine guns. Under\nthis line of thinking, the manufacturers and dealers violated federal and\nNevada laws prohibiting machine guns to be sold except as authorized by the\nNational Firearms Act.<\/p>\n\n\n\n<p>The judge also argued that the PLCAA, which would normally\nprotect gun makers from frivolous lawsuits, might not apply in this case because\nit includes an exception for companies that knowingly violate state or federal statutes.\nGun dealers are not protected under the PLCAA, in other words, because they illegally\nsold \u201cmachine guns\u201d to the Las Vegas shooter. &nbsp;<\/p>\n\n\n\n<p>\u201cThe Parsons plead facts from which a reasonable fact finder\ncould conclude that the shooter\u2019s use of an AR-15 modified to shoot\nautomatically in a mass shooting was reasonably foreseeable,\u201d Judge Gordon\nsaid. \u201cThe Parsons plead facts showing that the defendants\u2019 AR-15s could be\neasily modified with bump stocks to shoot automatically, which the shooter did\nwith tragic results. So the Parsons have sufficiently alleged causation.\u201d<\/p>\n\n\n\n<p>It\u2019s important to keep in mind that the judge\u2019s ruling does not have force of law in Nevada or anywhere else.
