{"id":128055,"date":"2020-04-29T18:14:43","date_gmt":"2020-04-29T22:14:43","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=128055"},"modified":"2020-04-29T18:14:43","modified_gmt":"2023-09-06T18:16:33","slug":"jackson-mayor-ban-open-carry","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/jackson-mayor-ban-open-carry\/","title":{"rendered":"Jackson Mayor Uses COVID-19 to Ban Open Carry, Calls For Its Full Repeal in Mississippi"},"content":{"rendered":"\n<p><\/p>\n\n\n\n\n\n\n\n<p><\/p>\n\n\n\n<p><a href=\"https:\/\/www.goodreads.com\/quotes\/717228-you-never-want-a-serious-crisis-to-go-to-waste\" target=\"_blank\" class=\"clickTracking\" campaign=\"jackson-mayor-ban-open-carry\" title=\"Jackson Mayor Uses COVID-19 to Ban Open Carry, Calls For Its Full Repeal in Mississippi\">Never let a crisis go to waste.<\/a><\/p>\n\n\n\n<p>In this vein, the mayor of Jackson, Mississippi, has banned open carry in his city during an emergency order that is set to expire April 30th. &nbsp;<\/p>\n\n\n\n<p>The ban on open carry was largely a flex of authority as it was only instituted four days ago on April 26th, but Jackson Mayor Chokwe Antar Lumumba is hoping to leverage this stunt into a statewide prohibition.&nbsp;<\/p>\n\n\n\n<p>\u201cIt is this call to action that has led to my decision to issue an Executive Order suspending Open Carry law during the Covid-19 civil emergency. Under State Statutes 45-17-7(e), I am given the discretion in the interest of public safety and welfare to issue such orders that are necessary for the protection of life and property,\u201d he said in a statement published to Youtube (see video above).&nbsp;<\/p>\n\n\n\n<p>\u201cWhile this order will only be in effect for a short period of time, I am calling on all Jackson residents, and all state and local leaders to act in the interest of our innocent children,\u201d he continued. \u201cRepeal the Open Carry law which makes it impossible for law enforcement to root out illegal firearms on our streets.\u201d<\/p>\n\n\n\n<p>It didn\u2019t take long for state officials to dash his hopes. In a <a href=\"https:\/\/shared.nrapvf.org\/sharedmedia\/1511180\/april-26-letter-to-mayor-lumumba_.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"jackson-mayor-ban-open-carry\" title=\"Jackson Mayor Uses COVID-19 to Ban Open Carry, Calls For Its Full Repeal in Mississippi\">strongly-worded letter <\/a>sent on Sunday, State Attorney General Lynn Fitch called for him to \u201cimmediately\u201d pull the ban.&nbsp;<\/p>\n\n\n\n<p>&#8220;Mississippians enjoy the right to lawfully open carry in all of Mississippi&#8217;s 82 counties and in every municipality within the State.&nbsp; The City of Jackson is no exception.&nbsp; The City lacks statutory authority to suspend a state statute or constitutional provision.&nbsp; Accordingly, I ask that you rescind the Order immediately,\u201d wrote Fitch. &nbsp;<\/p>\n\n\n\n<p>\u201cI take seriously my obligation to protect Mississippians&#8217; constitutional rights, and I will take every action available to my office to ensure these rights are not infringed upon,\u201d Fitch added. &nbsp;<\/p>\n\n\n\n<p>Making matters worse for Mayor Lumumba, he is now facing a lawsuit filed in federal court that accuses him of exploiting \u201cthe present health crisis\u201d to infringe on the 2A rights of law-abiding citizens.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/bj-baldwin-justified-homicide-in-las-vegas\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"jackson-mayor-ban-open-carry\" title=\"Jackson Mayor Uses COVID-19 to Ban Open Carry, Calls For Its Full Repeal in Mississippi\">BJ Baldwin of Baldwin Motorsports Involved in Justified Homicide in Las Vegas<\/a><\/h2>\n\n\n\n<p>The complaint was filed Tuesday in the U.S. District Court of the Southern District of Mississippi by the Mississippi Justice Institute on behalf of state Rep. Dana Criswell (R-Olive Branch). &nbsp;<\/p>\n\n\n\n<p>Rep. Dana Criswell said he was \u201cshocked\u201d by the mayor\u2019s swipe at one\u2019s right to openly bear arms. &nbsp;<\/p>\n\n\n\n<p>&#8220;As a citizen of the great state of Mississippi who has regular business in our capital city of Jackson, I was shocked by the recent announcement by Mayor Lumumba,\u201d Criswell said in a press release.<\/p>\n\n\n\n<p>\u201cI take the protection of myself and my family very seriously and believe deeply in the constitutional right to keep and bear arms,\u201d he continued. \u201cThe mayor\u2019s attempt to disarm me and deny me the ability of self-defense puts me and my family in danger any time we are in Jackson.\u201d<\/p>\n\n\n\n<p>While the temporary ban is set to expire (or has already expired by the time you read this), that&#8217;s really not the point.
