(Photo: Fred Schilling, Collection of the Supreme Court of the United States)<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The U.S. Supreme Court handed gun control advocates a major victory today by refusing to hear a suit brought by the New York State Rifle and Pistol Association against the City of New York. <\/p>\n\n\n\n<p>Gun rights proponents had hoped the court would use the case\nto strengthen Second Amendment rights after ten years of refusing to take up a\ngun-related case. The Court hasn\u2019t heard a gun case since its landmark <em>Heller<\/em>\nand <em>McDonald <\/em>decisions, and since then lower courts have consistently\nignored the robust protections those decisions offered.<\/p>\n\n\n\n<p>In an <a href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/18-280_ba7d.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-balks-new-york\" title=\"Supreme Court Balks, Refuses to Hear New York Pistol Case\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">unsigned opinion<\/a>, the court ruled that the New York case is now moot because New York City repealed the handgun law in question. The city had previously prohibited residents from transporting a handgun outside of city limits but promptly voided the law after SCOTUS decided to hear the case.<\/p>\n\n\n\n<p>\u201cThe State of New York amended its firearm licensing\nstatute, and the City amended the rule so that petitioners may now transport\nfirearms to a second home or shooting range outside of the city, which is the\nprecise relief that petitioners requested in the prayer for relief in their\ncomplaint,\u201d the court ruled. \u201cPetitioners\u2019 claim for declaratory and injunctive\nrelief with respect to the City\u2019s old rule is therefore moot.\u201d<\/p>\n\n\n\n<p>Justices Samuel Alito, Neil Gorsuch and Clarence Thomas dissented.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/saf-petitions-supreme-court-for-review-of-rodriguez-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-balks-new-york\" title=\"Supreme Court Balks, Refuses to Hear New York Pistol Case\">SAF Petitions Supreme Court for Review of Rodriguez Case<\/a> <\/h2>\n\n\n\n<p>The news isn\u2019t all bad, however. In his concurring opinion,\nJustice Brett Kavanaugh opened the door for the court to hear other Second\nAmendment cases in the near future. While he agreed with the majority\u2019s opinion\nabout this case\u2019s mootness, he shared Justice Alito\u2019s concern that lower courts\nare ignoring the <em>Heller<\/em> decision. <\/p>\n\n\n\n<p>\u201cThe Court should address that issue soon, perhaps in one of\nthe several Second Amendment cases with petitions for <em>certiorari<\/em> now\npending before the Court,\u201d he said.<\/p>\n\n\n\n<p>The Second Amendment Foundation has filed four gun-related cases with the Supreme Court, and they sounded an optimistic note in a <a href=\"https:\/\/www.saf.org\/scotus-moots-ny-gun-case-but-pending-cases-could-provide-2a-protection\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-balks-new-york\" title=\"Supreme Court Balks, Refuses to Hear New York Pistol Case\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">press release<\/a> about the New York case. <\/p>\n\n\n\n<p>\u201cThe Second Amendment Foundation currently has four cases\npending before the Supreme Court that could serve that purpose,\u201d SAF Founder\nAlan Gottlieb said, referring to Justice Kavanaugh\u2019s opinion. \u201cAnd we hope that\none or all of these cases gets heard and gives notice to lower courts that they\ncan no longer thumb their noses at the prior rulings that protect Second\nAmendment rights.\u201d<\/p>\n\n\n\n<p>The four SAF cases already submitted to the high court are&nbsp;<em>Rodriguez v. City of San Jose; Pena v. Cid, Culp v. Madigan<\/em>&nbsp;and&nbsp;<em>Mance v. Barr<\/em>. The Mance case involves SAF\u2019s sister organization, the Citizens Committee for the Right to Keep and Bear Arms as a plaintiff.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/supreme-court-sandy-hook-suit-proceed-remington\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-balks-new-york\" title=\"Supreme Court Balks, Refuses to Hear New York Pistol Case\">Supreme Court Allows Sandy Hook Suit to Proceed Against Remington<\/a> <\/h2>\n\n\n\n<p>In his dissent, Justice Alito argued that while the restrictive\nNew York law had been repealed, the controversy is still \u201clive\u201d and the Court\nhas a duty to intervene. <\/p>\n\n\n\n<p>A case becomes moot \u201conly when it is impossible for a court\nto grant any effectual relief whatever to the prevailing party.
