State Police in New Mexico shuttered a local gun store last week after the owner tried to reopen the business in defiance of the governor\u2019s closure of \u201cnonessential businesses.\u201d<\/p>\n\n\n\n

Back in March, Gov. Michelle Lujan Grisham declared that only \u201cessential\u201d businesses can remain open during this \u201cpublic health emergency.\u201d<\/p>\n\n\n\n

Omitted from the list of \u201cessential\u201d businesses are FFLs, gun shops.<\/p>\n\n\n\n

It should be noted that the Trump administration added the firearms industry \u2014 \u201cworkers supporting the operation of firearm or ammunition product manufacturers, retailers, importers, distributors, and shooting ranges\u201d \u2014 to its list of \u201ccritical infrastructure\u201d late last month<\/a>. \u00a0<\/p>\n\n\n\n

But that list is just a guideline for the states and is, therefore, non-binding.  Governors can still do as they wish.  <\/p>\n\n\n\n

Louie Sanchez, the owner of the store known as \u201cCalibers,\u201d spoke to local news affiliate KOB4<\/a> about the recent visitation from law enforcement.\u00a0 \u00a0<\/p>\n\n\n\n

\u201cState police showed up to Calibers and issued a cease and desist for us to operate,\u201d explained Sanchez. \u201cWhich isn’t very fair because of the fact that we feel like maybe we’re getting picked on because we took a stance again them.\u201d<\/p>\n\n\n\n

\u201cWe don’t think this is fair, the governor is literally picking winners and losers for who will stay in business,\u201d Sanchez added.<\/p>\n\n\n\n

A spokesperson for the governor\u2019s office said, \u201cNon-compliant businesses have been given numerous opportunities by the state to adjust and come into compliance with the public health order, which is unambiguous about the need to reduce and minimize person-to-person contact amid this pandemic. This is an example of a business that chose not to comply and thus was served with a cease-and-desist.\u201d<\/p>\n\n\n\n

Hopefully, the \u2018Rona virus is on its way out and we can all get back to business as usual in the coming weeks. \u00a0<\/p>\n\n\n\n

But if that fails, maybe suing the governor and the state of New Mexico will move the needle.  <\/p>\n\n\n\n

Alan Gottlieb, the founder of the Second Amendment Foundation, told GunsAmerica that legal action is underway to straighten things out in the Land of Enchantment. <\/p>\n\n\n\n

\u201cThe Second Amendment Foundation has already filed a lawsuit over New Mexico\u2019s closure of gun stores. The Governor is a rabid gun Prohibitionist and is using this heath crisis to further her anti-gun rights agenda,\u201d Gottlieb said.\u00a0<\/p>\n\n\n\n
