City of San Jose<\/em>, which involves the city\u2019s confiscation of legally-owned firearms and the city\u2019s refusal to return them.<\/p>\n\n\n\n<p>\u201cWe\u2019re encouraged\nby this development in the case,\u201d said SAF founder\nand Executive Vice President Alan M. Gottlieb. \u201cIf the city thought they could\njust ignore this case and make it go away, they\u2019re wrong.\u201d<\/p>\n\n\n\n<p>SAF is joined by the California Gun Rights Foundation on\nbehalf of plaintiff Mrs. Rodriguez, who is legally qualified to own firearms in\nthe state. Her firearms were seized seven years ago after her husband was taken\nto a hospital on a mental health issue. At the time, a San Jose police officer\nadvised Rodriguez he had authority to seize all firearms in the residence,\nincluding those belonging solely to her, which were all locked in a\nCalifornia-approved safe. The guns were taken without a warrant, and over\nRodriguez\u2019s objection.<\/p>\n\n\n\n<p>The\ncity was advised that the Court had directed the Clerk of the Court to request\na response from the city on or before May 20. <\/p>\n\n\n\n<p>\u201cThis\nis a significant development,\u201d Gottlieb said, \u201cbecause it signals the Supreme\nCourt is interested in the case.\u201d<\/p>\n\n\n\n<p>The Rodriguez case is the fourth SAF case currently before the high court. The others are <em>Pena v. Cid<\/em>, <em>Mance v. Barr<\/em> and <em>Culp v. Madigan<\/em>.
