{"id":126643,"date":"2020-04-01T15:59:05","date_gmt":"2020-04-01T19:59:05","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=126643"},"modified":"2020-04-01T15:59:05","modified_gmt":"2023-09-06T16:27:02","slug":"employee-jailed-after-shooting","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/employee-jailed-after-shooting\/","title":{"rendered":"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store"},"content":{"rendered":"\nWatch the latest video at <a href=\"https:\/\/www.foxnews.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"employee-jailed-after-shooting\" title=\"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store\">foxnews.com<\/a>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Update (4\/2): <\/strong>Prosecutors at Abushariah&#8217;s bond hearing showed the judge surveillance video that they say captures Abushariah shooting one of the burglars \u201cpoint-blank in the back.\u201d They also said Abushariah told investigators \u201cI wish him dead\u201d after detectives told him that he was going to be charged.   <\/p>\n\n\n\n<p>Abushariah has four prior assault and battery charges, one of which includes a protective order that prohibits him from possessing a gun. <\/p>\n\n\n\n<p>Abushariah&#8217;s lawyer argued this is a &#8220;reasonable self-defense case&#8221; and noted that the store was pitch black at the time of the incident. <\/p>\n\n\n\n<p>***<\/p>\n\n\n\n<p>A Virginia man has been jailed without bond after he opened fire on three masked suspects who tried to rob his store early Sunday morning. <\/p>\n\n\n\n<p>Hamzeh Abushariah, 33, had been sleeping in the backroom of a smoke shop in Arlington when he heard the front window\u2019s glass breaking around 4:30 a.m. Abushariah had been sleeping in the store to save money and avoid coronavirus, <a href=\"https:\/\/wjla.com\/news\/local\/arlington-employee-charged-shooting-robbers-owner-speaks-out\" target=\"_blank\" class=\"clickTracking\" campaign=\"employee-jailed-after-shooting\" title=\"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store\">according to<\/a> the store\u2019s owner, Jowan Zuber. <\/p>\n\n\n\n<p>Abushariah grabbed a handgun and opened the door to the sales floor, where he saw three masked suspects attempting to steal from the store, according to a police report obtained by <a href=\"https:\/\/www.arlnow.com\/2020\/03\/29\/police-store-employee-charged-after-shooting-would-be-thief\/?fbclid=IwAR2yBbyD2qwBDJfiNfj-IWseJORtujJFMzOC9C_9BunpBOtm0S3bLKI7NHk\" target=\"_blank\" class=\"clickTracking\" campaign=\"employee-jailed-after-shooting\" title=\"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">local media<\/a><\/p>\n\n\n\n<p>Abushariah opened fire on the three suspects, striking one\nwhile the other two fled. The suspect who was shot was a juvenile who sustained\na \u201cserious but not life-threatening injury,\u201d according to police. <\/p>\n\n\n\n<p>The police report also notes that Abushariah retreated to the backroom after his initial shots but returned to fire again as the suspects fled. <\/p>\n\n\n\n<p>Zuber told Fox News\u2019 Tucker Carlson that when police arrived,\nthey asked Abushariah why he didn\u2019t run out the back door. <\/p>\n\n\n\n<p>&#8220;It&#8217;s very sad for America today&nbsp;as American\ncitizens practice&nbsp;their Second Amendment to&nbsp;protect the store and\ntheir&nbsp;lives,&#8221; Zuber said. &#8220;Do you know what the [responding]\npolice officer told him [Abushariah]? &#8216;Why didn&#8217;t you run out the\nback&nbsp;door?'&#8221;<\/p>\n\n\n\n<p>Abushariah was arrested and charged with malicious wounding,\nreckless handling of a firearm, and violation of a protective order. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/legal-argumentsclosing-gun-shops\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"employee-jailed-after-shooting\" title=\"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"The Legal Arguments for Closing Gun Shops During COVID-19 Pandemic (opens in a new tab)\">The Legal Arguments for Closing Gun Shops During COVID-19 Pandemic<\/a> <\/h2>\n\n\n\n<p>&#8220;This is very&nbsp;sad,&#8221; Zuber told Carlson.\n&#8220;I&nbsp;was born in Arlington, I pay&nbsp;taxes.&nbsp;The gun is\nregistered and&nbsp;everything is perfect. But I&nbsp;can&#8217;t believe as American&nbsp;citizens,\nwe are being treated&nbsp;like this.&nbsp;And this gets the criminals\nout&nbsp;there [thinking]&nbsp;&#8216;We can go rob stuff, kill people and hurt\npeople and&nbsp;guess what, people have to run&nbsp;out the back\ndoor&#8217;.&nbsp;This is mind-boggling.&#8221;<\/p>\n\n\n\n<p>Zuber said he had purchased two handguns several weeks prior\nbecause he feared civil unrest as a result of the COVID-19 pandemic. <\/p>\n\n\n\n<p>\u201cWe bought protection for the store just in case, because on Facebook you see a lot of robberies, a lot of things going on,\u201d Zuber told <a href=\"https:\/\/wjla.com\/news\/local\/arlington-employee-charged-shooting-robbers-owner-speaks-out\" target=\"_blank\" class=\"clickTracking\" campaign=\"employee-jailed-after-shooting\" title=\"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">WJLA<\/a>.<\/p>\n\n\n\n<p>Multiple reports have <a href=\"https:\/\/www.gunsamerica.com\/new-york-suspends-pistol-permitting\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"employee-jailed-after-shooting\" title=\"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">speculated<\/a> that police response times will be slowed during the COVID-19 outbreak, and police departments across the country have said that they <a href=\"https:\/\/www.mlive.com\/public-interest\/2020\/03\/michigan-police-not-physically-responding-to-some-calls-in-order-to-avoid-coronavirus-spread.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"employee-jailed-after-shooting\" title=\"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">won\u2019t be responding<\/a> to certain types of crime. <\/p>\n\n\n\n<p>Arlington County Police say Abushariah was charged with\nviolating a protective order because he was not allowed to have a firearm. <\/p>\n\n\n\n<p>Arlington County officials also encouraged citizens not to rush to judgment and claimed to have additional details that informed their decision to prosecute Abushariah. &nbsp;<\/p>\n\n\n\n<blockquote class=\"twitter-tweet\" data-conversation=\"none\"><p lang=\"en\" dir=\"ltr\">4\/5 This much we can say: there\u2019s evidence we are not at liberty to share that support the charges, the decision was not made lightly, and we are not at the end of charging decisions as to the breaking &amp; entering. He told Carlson he \u201cheard [Abushariah] coughing very hard\u201d and believes people should be kept away from jail at this time. <\/p>\n\n\n\n<p>As a general rule, the law in Virginia does not require a person to retreat prior to deadly force when confronted with an aggressor, provided the person did not provoke the confrontation and the force is proportional to the harm threatened, <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.tmwilsonlaw.com\/criminal-law\/self-defense#2\" target=\"_blank\" class=\"clickTracking\" campaign=\"employee-jailed-after-shooting\" title=\"Employee Jailed After Shooting Would-Be Thief Who Broke into His Store\" target=\"_blank\">according to<\/a> Virginia lawyer Thomas M.
