Phil Murphy and State Police Supt. Patrick Callahan, adding several plaintiffs asserting violation of civil rights under color of law by shutting down firearms dealerships in the Garden State.<\/p>\n\n\n\n<p>Plaintiffs\nhave also filed a show cause motion for a temporary restraining order and\npreliminary injunction.<\/p>\n\n\n\n<p>Joining SAF and its\noriginal co-plaintiffs are Gina DiFazio, Jontell Platts, Witold Kwiatkowski,\nLegacy Indoor Range and Armory LLC and the Firearms Policy Coalition (FPC). The\noriginal plaintiffs were SAF, Racing Rails LLC d\/b\/a Legend Firearms, the New\nJersey Second Amendment Society and Robert Kashinsky. They are represented by\nnoted civil rights attorney David Jensen of New York and Adam Kraut of\nCalifornia.<\/p>\n\n\n\n<p>Murphy and Callahan\nare being sued in their official capacities. The case, which was filed in the\nU.S. District Court for the State of New Jersey is known as <em>Kashinsky v. Murphy<\/em>.<\/p>\n\n\n\n<p>\u201cWe are thrilled to\nbe joined by our friends at FPC, along with other New Jersey residents whose\nSecond Amendment rights are being trampled by Gov. Murphy\u2019s order,\u201d said SAF\nfounder and Executive Vice President Alan M. Gottlieb. \u201cAs we say in our\namended complaint, Murphy\u2019s order has forcibly eliminating all lawful channels\nof access to constitutionally protected arms. By requiring that people not\nleave their homes to legally purchase firearms and ammunition, even if they\nfollow public health guidance for social distancing, their rights are being\ndenied.<br \/>\n<br \/>\n\u201cTo guarantee this violation,\u201d he added, \u201cMurphy has mandated the closure of\nall retail businesses that sell firearms, and the State Police has closed the\nportal on their website for firearms background checks. Individually and collectively,\nthese actions amount to a ban on obtaining firearms in the State of New Jersey.<\/p>\n\n\n\n<p>\u201cTen years ago,\u201d Gottlieb recalled, \u201cThe U.S. Supreme Court proclaimed that the Second Amendment is not a \u2018second-class right\u2019 but it\u2019s being treated that way in New Jersey.
