(<em>Photo: Facebook)<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>BELLEVUE, WA<\/strong> \u2013 In a move directly linked to the ongoing COVID-19 pandemic, the Second Amendment Foundation has filed a federal lawsuit against New Jersey Gov. Philip D. Murphy and State Police Supt. Patrick J. Callahan, asserting violation of civil rights under color of law by shutting down firearms dealerships in the Garden State, thus preventing citizens from exercising their rights under the Second and Fourteenth amendments.<\/p>\n\n\n\n<p>Murphy and Callahan\nare being sued in their official capacities. The case, which was filed in the\nU.S. District Court for the State of New Jersey is known as <em>Kashinsky v. Murphy<\/em>.<\/p>\n\n\n\n<p>Joining SAF in this\naction is the New Jersey Second Amendment Society, on behalf of Robert Kashinsky\nand Legend Firearms, a gun shop in the state. They are represented by noted\ncivil rights attorney David Jensen.<\/p>\n\n\n\n<p>Kashinsky sought to purchase a firearm for personal protection during the current crisis, but Murphy issued Executive Order 107 on March 21, which ordered all non-essential retail businesses closed to the public. The order does not include licensed firearms dealers on its list of \u201cessential\u201d businesses that may continue operating during the crisis.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/ca-gov-gavin-newsom-martial-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-nj-governor-for-deprivation-of-rights\" title=\"SAF Sues NJ Governor for Deprivation of Rights\">CA Gov. Gavin Newsom: \u2018We have the ability to do martial law\u2026if necessary\u2019<\/a><\/h2>\n\n\n\n<p>\u201cIn order for New\nJersey residents to purchase firearms,\u201d noted SAF founder and Executive Vice\nPresident Alan M. Gottlieb, \u201cthey must go through a licensed firearms retailer\nand pass a background check. However, Murphy\u2019s order was subsequently followed\nby a notice posted on the State Police website that the agency is no longer\nconducting background checks. <\/p>\n\n\n\n<p>\u201cGov. Murphy cannot\nsimply suspend the Second Amendment, and neither can Supt. Callahan,\u201d he\ncontinued. \u201cYet, under this emergency order, that\u2019s exactly what they\u2019re doing.\nThe Constitution, and federal law, don\u2019t allow that.
