Gavin Newsom mentioned this week the possibility of invoking martial law during the COVID-19 crisis.<\/p>\n\n\n\n<p>\u201cIf you want to establish a framework of martial law, which is ultimate authority and enforcement, we have the capacity to do that, but we are not feeling at this moment that is a necessity,\u201d Newsom said Tuesday during a press briefing, noting that he had put the National Guard on alert. &nbsp; &nbsp;<\/p>\n\n\n\n<p>\u201cI don&#8217;t want to get to the point of being alarmist, but we are scaling all of our considerations,\u201d he continued.<\/p>\n\n\n\n<p>A spokesperson for the governor walked back the statement a bit on Wednesday, suggesting that if Newsom enacted martial law it wouldn\u2019t be a military-style deployment. \u00a0<\/p>\n\n\n\n<p>\u201cWe don\u2019t want this to be scary for people,&#8221; said&nbsp; Brian Ferguson, spokesman for the Governor&#8217;s Office of Emergency Services. \u201cThis is a humanitarian mission to support health and safety.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/san-jose-authorities-shut-down-gun-shop-its-non-essential-per-mayor\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ca-gov-gavin-newsom-martial-law\" title=\"CA Gov. Gavin Newsom: \u2018We have the ability to do martial law\u2026if necessary\u2019\">San Jose Authorities Shut Down Gun Shop, It\u2019s \u2018Non-Essential\u2019 Per Mayor<\/a><\/h2>\n\n\n\n<p>Martial law is only supposed to be used during \u201cbattlefield conditions\u201d or when the U.S. is being invaded, Vermont Law School Professor Stephen Dycus told the <a href=\"https:\/\/www.mercedsunstar.com\/news\/article241323051.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"ca-gov-gavin-newsom-martial-law\" title=\"CA Gov. Gavin Newsom: \u2018We have the ability to do martial law\u2026if necessary\u2019\">Merced Sun-Star<\/a>. &nbsp;<\/p>\n\n\n\n<p>However, governors do have great latitude in how they utilize their state militias, according to Dycus who co-authored the book, \u201c<a href=\"https:\/\/www.amazon.com\/Soldiers-Home-Front-Domestic-American\/dp\/0674736745\" target=\"_blank\" class=\"clickTracking\" campaign=\"ca-gov-gavin-newsom-martial-law\" title=\"CA Gov. Gavin Newsom: \u2018We have the ability to do martial law\u2026if necessary\u2019\">Soldiers on the Home Front: The Domestic Role of the American Military<\/a>.\u201d<\/p>\n\n\n\n<p>\u201cGovernors have a lot of flexibility as commander in chief of their state militias, what we now call National Guard, to use those Guard forces to do a variety of things, including law enforcement,\u201d Dycus explained. \u201cOur experience with martial law is limited, and the law about what martial law is or the circumstances that would justify it are unclear.\u201d<\/p>\n\n\n\n<p>Under a <a href=\"https:\/\/law.jrank.org\/pages\/8453\/Martial-Law.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"ca-gov-gavin-newsom-martial-law\" title=\"CA Gov.
