{"id":126024,"date":"2020-03-17T22:06:41","date_gmt":"2020-03-18T02:06:41","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=126024"},"modified":"2020-03-17T22:06:41","modified_gmt":"2023-09-06T15:51:06","slug":"mayor-of-new-orleans-ban-sale-firearms","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/mayor-of-new-orleans-ban-sale-firearms\/","title":{"rendered":"Mayor of New Orleans&#8217; Declaration of Emergency Allows Her to Ban Sale and Transport of Firearms"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1000\" height=\"600\" title=\"Mayor of New Orleans' Declaration of Emergency Allows Her to Ban Sale and Transport of Firearms\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2020\/03\/cantrell.png\" alt=\"Mayor of New Orleans' Declaration of Emergency Allows Her to Ban Sale and Transport of Firearms\" class=\"wp-image-126025\" srcset=\"https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/03\/cantrell.png 1000w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/03\/cantrell-400x240.png 400w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/03\/cantrell-150x90.png 150w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2020\/03\/cantrell-768x461.png 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><figcaption><em>New Orleans Mayor LaToya Cantrell now has the power to ban the sale and transport of firearms. <\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The mayor of New Orleans issued a proclamation last week giving her the power to ban the sale and transport of firearms in the wake of the COVID-19 outbreak. <\/p>\n\n\n\n<p>Mayor LaToya Cantrell has not indicated whether she plans to use her newfound power, but the sweeping <a href=\"https:\/\/www.nola.gov\/mayor\/executive-orders\/emergency-declarations\/20200311-mayoral-proclamation-of-a-state-of-emergency-due-to-covid-19\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"mayor-of-new-orleans-ban-sale-firearms\" title=\"Mayor of New Orleans' Declaration of Emergency Allows Her to Ban Sale and Transport of Firearms\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">declaration of emergency<\/a> could significantly limit the Second Amendment rights of New Orleans residents.<\/p>\n\n\n\n<p>\u201cSubject to the provisions of Act 275 of 2006 (Regular Session),\nthe Emergency Authority is hereby empowered, if necessary, to suspend or limit\nthe sale, dispensing, or transporting of alcoholic beverages, firearms,\nexplosives, and combustibles,\u201d the proclamation states.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.legis.la.gov\/Legis\/ViewDocument.aspx?d=399339\" target=\"_blank\" class=\"clickTracking\" campaign=\"mayor-of-new-orleans-ban-sale-firearms\" title=\"Mayor of New Orleans' Declaration of Emergency Allows Her to Ban Sale and Transport of Firearms\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Act 275 of 2006<\/a> prohibits the mayor from confiscating lawfully possessed firearms, but New Orleans mayors have historically been more than willing to curtail the rights of their citizens. Act 275 of 2006 was passed after then-Mayor Ray Nagin tried seizing firearms in the wake of Hurricane Katrina. As Second Amendment Foundation executive vice president Alan Gottlieb noted in a statement, Nagin\u2019s administration had to be sued before it started respecting Second Amendment rights.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Following Hurricane Katrina, we sued the city when then-Mayor Ray Nagin\u2019s administration began confiscating firearms from law-abiding citizens for no good reason. The federal court order the city to cease confiscations.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>We sued New Orleans then, and we\u2019ll do it again.&nbsp;The presence of a nasty disease does not suspend any part of the Bill of Rights, no matter what some municipal, state or even federal politician may think. While we certainly recognize the seriousness of this virus and its ability to spread rapidly, treating Covid-19 and taking steps to prevent it from infecting more people has nothing at all to do with the exercise of the right to keep and bear arms under the Second Amendment.<\/p><\/blockquote>\n\n\n\n<p>Gottlieb added, \u201cPeople legally licensed to carry should not have their right to do so suddenly curtailed because some politician panicked. In a <a href=\"https:\/\/nola.gov\/mayor\/executive-orders\/emergency-declarations\/03162020-mayoral-proclamation-to-promulgate-emergency-orders-during-the-state-of-emergency-due-to-co\/?utm_campaign=City_of_New_Orleans&amp;utm_content=&amp;utm_medium=email&amp;utm_source=govdelivery&amp;utm_term=\" target=\"_blank\" class=\"clickTracking\" campaign=\"mayor-of-new-orleans-ban-sale-firearms\" title=\"Mayor of New Orleans' Declaration of Emergency Allows Her to Ban Sale and Transport of Firearms\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">second proclamation<\/a> on March 15, Cantrell specifically highlights her authority to \u201csuspend or limit the sale, dispensing, or transportation of alcoholic beverages\u201d as legal justification for her decision. <\/p>\n\n\n\n<p>Cantrell isn\u2019t the first mayor during the COVID-19 outbreak to empower herself to restrict firearm use. Mayor Deborah Frank Feinen of Champaign, Illinois, passed a resolution that allows city officials to ban firearms it they deem the action necessary.
