No other gun rights\norganization has ever had this many pending cases submitted to the Supreme\nCourt at the same time, said SAF founder and Executive Vice President Alan M.\nGottlieb.<\/p>\n\n\n\n<p>SAF is joined by the\nCalifornia Gun Rights Foundation on behalf of plaintiff Lori Rodriguez. Her\nfirearms were seized in 2013 after her husband was taken to a hospital on a\nmental health issue. A San Jose police officer at the time advised Rodriguez he\nhad authority to seize all firearms in the residence, including those belonging\nsolely to her, which were all locked in a California-approved safe. The guns\nwere seized without a warrant, and over Rodriguez\u2019s objection.<\/p>\n\n\n\n<p>The case has been\nmaking its way through the lower courts for seven years, even though the courts\nrecognize that Lori Rodriguez could legally purchase new firearms. San Jose\nauthorities simply refuse to return the guns she already legally owns. Last\nsummer, the Ninth Circuit Court of Appeals upheld a lower court\u2019s decision to\ngrant summary judgment to the defendants, ruling the defendants were allowed to\nseize her guns under a concept called \u201ccommunity caretaking.\u201d<\/p>\n\n\n\n<p>\u201cThis case is a\ntravesty,\u201d Gottlieb stated. \u201cLori Rodriguez is not a criminal, nor is she\nprohibited by law from owning firearms. Yet she\u2019s essentially been robbed by\nthe City of San Jose and its police department, with the cooperation of lower\ncourts, including the Ninth Circuit Court of Appeals.<\/p>\n\n\n\n<p>\u201cWhen a municipal\ngovernment agency can seize property without a warrant,\u201d he added, \u201cand be\nprotected by the lower courts in so doing, it is time for the U.S. Supreme\nCourt to step in and right this dangerously tilted ship before it capsizes.\u201d<\/p>\n\n\n\n<p>&nbsp;\u201cMrs. Rodriguez has at all times complied with\nCalifornia\u2019s many gun control laws, including those requiring locked storage,\u201d\nsaid plaintiff\u2019s noted civil rights attorney Don Kilmer. \u201cBut the City of San\nJose outrageously continues to refuse to return the constitutionally protected\nproperty they unlawfully took from her years ago. Governments have no reason\nand no right to take guns from law-abiding people who are legally eligible to\nkeep and bear arms, full stop. The Constitution does not have a \u2018gun\u2019 exception\nto fundamental Fourth and Fifth Amendment rights, but that is exactly what the\nNinth Circuit\u2019s dangerous decision means. We hope the Supreme Court will\nvindicate our clients\u2019 rights and restore the rule of law in the Ninth\nCircuit.\u201d<\/p>\n\n\n\n<p>Highly-respected\nappellate attorney Erik Jaffe in Washington, D.C., who also represents the\nplaintiffs, added, \u201cIn the United States, governments cannot take a law-abiding\nwoman&#8217;s property, without a warrant, and refuse to give it back. And not only\nare the City of San Jose and its police department doing just that, they also\nviolated her fundamental Second Amendment rights in the process. Constitutional\namendments are not mere suggestions. This case offers a vehicle for the Supreme\nCourt to remind lower courts and government agencies that constitutional\nprinciples are not different or diminished in cases involving firearms.\u201d<\/p>\n\n\n\n<p>The three other\nSAF-related cases already submitted for Supreme Court review are Pena v. Cid,\nMance v. Barr and Culp v. Madigan.
