<\/p>\n\n\n\n

Is society better off with too much gun control, or too little?<\/p>\n\n\n\n

That\u2019s the \u201cessential issue of the gun debate\u201d that\nconstitutional law and firearms policy scholar David Kopel tackles in a new publicly\navailable chapter from his 2018 textbook, Firearms Law and the Second\nAmendment.<\/em> <\/p>\n\n\n\n

\u201cThe global historical evidence shows that too much gun control\nis much more dangerous than too little gun control,\u201d he concludes. \u201cDisorganized\ncriminals can kill a lot of people, but criminal governments are far more\ndeadly, by about two orders of magnitude. Therefore, any society that accepts\nthe government being stronger than people is, in the long run, creating the\nconditions for manmade disaster of the deadliest sort.\u201d<\/p>\n\n\n\n

Kopel begins the chapter by comparing the gun-related\nhomicide rate in Europe with that of the United States. He finds that over the\ncourse of the twentieth century, Europe saw about 750,000 fewer gun-related\nhomicides than the United States after adjusting for population.  <\/p>\n\n\n\n

By making several assumptions favorable to the gun control cause (that none of the homicides would have been committed with other means, for example), Kopel concludes that, arguably, the failure of the United States to adopt European-style gun control is responsible for nearly three-quarters of a million excess deaths in the United States in the twentieth century. <\/p>\n\n\n\n

That number, however, pales in comparison to the number of\npeople murdered by tyrannical governments that were able to run roughshod over\ntheir disarmed populace. If these deaths are taken into account, Europe must\ntake responsibility for about 87.1 million additional people murdered by the\nstate in the twentieth century. <\/p>\n\n\n\n

Myriad factors influence both Europe\u2019s relatively low firearm-homicide rate and the prevalence of tyrannical governments. But Kopel\u2019s analysis shows a strong correlation between tyranny, disarmament, and \u201cdemocide,\u201d or “the intentional killing of an unarmed or disarmed person by government agents.\u201d<\/p>\n\n\n\n

Totalitarian governments are far more likely than democracies\nto engage in high-volume murder, and communists are especially likely to kill\ntheir own citizens en masse<\/em>, he\nargues. <\/em><\/p>\n\n\n\n

\u201cThe best means to reduce the risk of democide is not to\nhave a totalitarian government. And, especially, not to have a communist\ngovernment,\u201d Kopel says. \u201cThe data further indicate that just about the only\nmeans of avoiding the risk of high-volume murder by government is to live in a\ndemocracy.\u201d<\/p>\n\n\n\n

Disarmament is often the first step of many totalitarian\ngovernments, as Kopel\u2019s extensive comparative analysis indicates. <\/p>\n\n\n\n

\u201cThroughout human history, totalitarians have always\ndisarmed their subjects,\u201d he notes. \u201cThis indicates that they considered\nwidespread citizen armament to be a serious danger to their regimes.\u201d<\/p>\n\n\n\n

Mao in China in 1949, Castro in Cuba in 1959, and the Khmer\nRouge in Cambodia in 1975 all began their dictatorships by prohibiting or\nsignificantly restricting private gun ownership. <\/p>\n\n\n\n

Same story in Germany. Kopel notes that the lawfully elected\nNazi party took advantage of a gun registration system put in place by the\nWeimar Republic to \u201calmost immediately\u201d seize guns, knives, and other firearms\nfrom individuals in other political parties, especially the Social Democrats,\nand from Jews. They also outlawed independent shooting ranges and required that\nany range or club be registered with and ruled by the state.<\/p>\n\n\n\n

On the other side of the spectrum, Kopel notes that England\u2019s\n\u201cdespotically-inclined\u201d Henry VIII restrained his tyrannical tendencies in\nlarge part due to the \u201cvery existence\u201d of a well-armed populace.  Four hundred years later, Switzerland avoided\nbecoming part of the Holocaust in part due to its heavily armed and\nwell-regulated citizen militia. <\/p>\n\n\n\n

To those who don\u2019t believe tyranny could ever come to the\nUnited States, Kopel had this to say:<\/p>\n\n\n\n

\u201cOnly a foolish version of American exceptionalism would\nimagine that the United States has been granted some sort of permanent immunity\nfrom the dangers of totalitarianism. \u2018It can\u2019t happen here,\u2019 people have often\ntold themselves. Yet it did happen almost everywhere in Europe, including in\ndemocratic, economically advanced, and socially progressive nations such as\nGermany.\u201d<\/p>\n\n\n\n
