{"id":119270,"date":"2019-12-02T15:01:23","date_gmt":"2019-12-02T20:01:23","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=119270"},"modified":"2019-12-02T15:01:23","modified_gmt":"2023-09-06T04:58:16","slug":"saf-cautious-optimism-after-scotus-hears-arguments-in-ny-case","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/saf-cautious-optimism-after-scotus-hears-arguments-in-ny-case\/","title":{"rendered":"SAF: &#8216;Cautious Optimism&#8217; After SCOTUS Hears Arguments in NY Case"},"content":{"rendered":"\n<p><strong>BELLEVUE, WA<\/strong> \u2013 The Second Amendment Foundation today expressed high hopes that the U.S. Supreme Court will \u201cstep up to the plate\u201d and expand further on the right to keep and bear arms that is protected by the Second Amendment in the case of the <em>New York State Rifle and Pistol Association v. City of New York.<\/em><\/p>\n\n\n\n<p>SAF\nBoard member and syndicated broadcaster Tom Gresham was in the audience and he\nnoted afterwards, \u201cThis may be the case that indicates whether the court\nconsiders the Second Amendment to be a legitimate right on the same level as\nthe First Amendment.\u201d<\/p>\n\n\n\n<p>Gresham\nsuggested that if the high court decides to reject the case, it will do so\nshortly. However, if the Court decides to rule in the case, that decision could\nbe as far away as June, on the final day of the current session. The case is a\nchallenge of a now-changed city regulation that forbade handgun owners from\ntaking their guns outside the city limits. <\/p>\n\n\n\n<p>\u201cIt\nhas been ten years since the Supreme Court took a Second Amendment case, and\nthis one could have far reaching ramifications,\u201d noted SAF founder and\nExecutive Vice President Alan M. Gottlieb. \u201cThe last time the court ruled on\nthe Second Amendment was in 2010 with <em>McDonald\nv. City of Chicago<\/em>, our landmark victory that incorporated the Second\nAmendment to the states via the 14<sup>th<\/sup> Amendment.<\/p>\n\n\n\n<p>\u201cWe\u2019re\nhopeful the High Court sees through New York\u2019s attempt to moot this case by\nchanging the law,\u201d he continued. \u201cThe only reason that change was made is\nbecause the Court accepted the case for review earlier this year, and everybody\nknows it. That maneuver suggests the city knew all along its restriction would\nnot pass constitutional muster, but only changed the law in an effort to\nprevent a court ruling that smacked it down.<\/p>\n\n\n\n<p>\u201cWe\nwill be watching this case closely,\u201d Gottlieb said. \u201cThe City of New York, and\nany other government body for that matter, should not be allowed to trample on\na constitutional right and then change a law at the last minute to avoid being\npenalized for their demagoguery.\u201d<\/p>\n\n\n\n<p>The case is <em>New York State Rifle and Pistol Association v.
