Unlike this CZ, it was unloaded.<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Should gun owners in Ohio be permitted to \u201ccarry\u201d their firearms in their homes while intoxicated?<\/p>\n\n\n\n<p>That\u2019s the question at issue in a case headed for the Ohio\nSupreme Court in February.<\/p>\n\n\n\n<p>Fredrick Weber was convicted in June of 2018 under a 45-year-old law that prohibits Ohio residents from carrying or using a firearm while intoxicated. Weber appealed his conviction to the 12th District Court of Appeals, which confirmed the municipal court\u2019s ruling. Now, on a 4-3 vote, the state Supreme Court has agreed to hear the case. <\/p>\n\n\n\n<p>According to <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.supremecourt.ohio.gov\/rod\/docs\/PDF\/12\/2019\/2019-Ohio-916.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"ohio-supreme-court-firearms-home-intoxicated\" title=\"Ohio Supreme Court to Decide Whether People Can Have Firearms in the Home While Intoxicated\" target=\"_blank\">court documents<\/a>, a deputy and a sergeant from the Clermont County Sheriff&#8217;s Office were dispatched to Weber\u2019s home after his wife reported that her husband was carrying a firearm while intoxicated. Even though she told deputies that Weber had put his firearm away, she let them into the home, where they saw Weber coming out of a doorway and holding a shotgun.<\/p>\n\n\n\n<p>The shotgun was pointed towards the ground, and deputies confirmed that it was unloaded. Weber claimed he had been wiping down the firearm to put it away.<\/p>\n\n\n\n<p>Deputies noticed that Weber\u2019s eyes were bloodshot and glassy, his speech was slurred, and he was unsteady on his feet. Weber admitted he was drunk and subsequently failed a field sobriety test. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/nj-court-denies-gun-permit-for-man-because-wife-has-alcohol-problem\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ohio-supreme-court-firearms-home-intoxicated\" title=\"Ohio Supreme Court to Decide Whether People Can Have Firearms in the Home While Intoxicated\">NJ Court Denies Gun Permit for Man Because Wife Has Alcohol Problem<\/a> <\/h2>\n\n\n\n<p>In his appeal, Weber\u2019s attorneys argued that their client wasn\u2019t using the shotgun \u201cas a firearm\u201d and had not or was not about to commit a crime. They also argued that the law prohibiting the use or possession of firearms while intoxicated is unconstitutional because it infringed on their client\u2019s rights to keep and bear arms and defend himself.<\/p>\n\n\n\n<p>They further argued that a person\u2019s intoxication level shouldn\u2019t have a bearing on possessing a weapon \u201cin the hearth and home,\u201d according to the <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.wsaz.com\/content\/news\/Arguments-set-for-case-of-Ohio-gun-owner-drunk-inside-house-565041862.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"ohio-supreme-court-firearms-home-intoxicated\" title=\"Ohio Supreme Court to Decide Whether People Can Have Firearms in the Home While Intoxicated\" target=\"_blank\">Associated Press<\/a>. <\/p>\n\n\n\n<p>\u201cWeber suggests that it was never the intention of the constitutional framers that someone like him (or anyone similarly situated) be guilty of possessing a weapon while intoxicated in his\/her home,\u201d Weber\u2019s appeal reads, according to <a href=\"https:\/\/www.toledoblade.com\/local\/courts\/2019\/09\/20\/cities-defend-state-law-forbidding-guns-while-drunk\/stories\/20190920117\" target=\"_blank\" class=\"clickTracking\" campaign=\"ohio-supreme-court-firearms-home-intoxicated\" title=\"Ohio Supreme Court to Decide Whether People Can Have Firearms in the Home While Intoxicated\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">The Toledo Blade<\/a>. <\/p>\n\n\n\n<p>\u201cIf such be the case, any off-duty law enforcement officer\n(or any other person that has firearms in the residence) who has a few\nalcoholic beverages while in his\/her house and has law enforcement happen into\nthat residence can be charged and convicted under a ritualistic or formulaic\nimplementation of the statute,\u201d it reads.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/supreme-court-sandy-hook-suit-proceed-remington\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"ohio-supreme-court-firearms-home-intoxicated\" title=\"Ohio Supreme Court to Decide Whether People Can Have Firearms in the Home While Intoxicated\">Supreme Court Allows Sandy Hook Suit to Proceed Against Remington<\/a> <\/h2>\n\n\n\n<p>Cities in Ohio are defending the state law. They argue that\nthe law provides a necessary tool for law enforcement officers responding to\ndangerous, alcohol-soaked incidents. <\/p>\n\n\n\n<p>\u201cTheir police officers are the first to respond to domestic\nviolence incidents, interpersonal gun violence, gun suicides, and unintentional\nshootings, all of which are made more lethal by the combination of guns and\nalcohol,\u201d reads a brief filed by Toledo, Lima, Columbus, Cincinnati, Akron, and\nDayton, according to The Blade. \u201cThey are the ones who have to respond to\ndomestic violence calls where the mixture of guns and alcohol often leads to\nwomen being killed and officers being assaulted.\u201d<\/p>\n\n\n\n<p>Toledo Law Director Dale Emch put an even finer point on it:<\/p>\n\n\n\n<p>\u201cIt\u2019s just common sense that the intoxicated should not be\ncarrying weapons in my mind, whether in your home or not,\u201d he said. \u201cThat\u2019s\njust a bad recipe.\u201d<\/p>\n\n\n\n<p>Oral arguments aren\u2019t scheduled until February 25, and a final decision isn\u2019t expected for months, according to the AP. \u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"text-align:center\">***<a href=\"https:\/\/gunsamerica.com\/\" campaign=\"BuySellGA_Register\" target=\"_blank\" class=\"clickTracking\">Buy and Sell on GunsAmerica!<\/a>*** <\/h2>\n","protected":false},"excerpt":{"rendered":"<p>Should gun owners in Ohio be permitted to \u201ccarry\u201d their firearms in their homes while intoxicated?
