The Supreme Court has refused to dismiss a suit brought by family members of Sandy Hook victims against Remington Arms Company. The order, published today, denies certiorari<\/a> <\/em>but does not provide justification. <\/p>\n\n\n\n

Family members of several victims killed in the 2012 Sandy Hook massacre sued Remington in 2014 for the gun company\u2019s alleged culpability in the murders. The Connecticut Supreme Court dismissed much of the families\u2019 case earlier this year, but the court agreed with the portion of the suit that alleged Remington may have engaged in \u201cunethical and irresponsible marketing practices.\u201d<\/p>\n\n\n\n

With today\u2019s order from the U.S. Supreme Court, attorneys\nfor the plaintiffs will be able to test whether a gun company can be held\nliable for how it markets a firearm that is later used in a crime. <\/p>\n\n\n\n

Second Amendment Foundation Founder Alan Gottlieb told GunsAmerica via email that the Supreme Court will likely take the case if the lower courts rule against Remington.<\/p>\n\n\n\n

Still, he does not find any merit in the narrower suit that\nwas allowed to move forward.<\/p>\n\n\n\n

\u201cThis suit is just plain wrong and should never have been\nallowed to proceed,\u201d he said. <\/p>\n\n\n\n

In the case\u2019s first major test, the Connecticut Supreme Court ruled in a 4-3 decision<\/a> that Remington cannot be held liable for simply selling its AR-style Bushmaster XM15-E2S rifle that was allegedly used in the Sandy Hook massacre.<\/p>\n\n\n\n

But they also ruled that the Protection of Lawful Commerce\nin Arms Act (PLCAA) includes an exception that allows the lawsuit to be brought\nagainst the company\u2019s marketing practices. <\/p>\n\n\n\n

\u201cCongress did not intend to immunize firearms suppliers who\nengage in truly unethical and irresponsible marketing practices promoting\ncriminal conduct,\u201d the court said. \u201cIt falls to a jury to decide whether the\npromotional schemes alleged in the present case rise to the level of illegal\ntrade practices and whether fault for the tragedy can be laid at their feet.\u201d<\/p>\n\n\n\n

At trial, Sandy Hook families cited examples of what they believe are \u201cunethical, oppressive, immoral, and unscrupulous\u201d advertisements that extol the \u201cthe militaristic and assaultive qualities of the rifle.\u201d Furthermore, they argued, the Sandy Hook murderer was \u201cespecially susceptible to militaristic marketing\u201d due to his aspirations of being in the military.<\/p>\n\n\n\n

Gottlieb called that rationale \u201cabsurd\u201d at the time.<\/p>\n\n\n\n

\u201cDid the advertising even remotely suggest that the\nBushmaster is best for murdering people?\u201d he asked. \u201cThat\u2019s a stretch of\ncredulity worthy of surgical elastic.\u201d<\/p>\n\n\n\n

\u201cThere is no evidence the killer was driven by any\nadvertising whatsoever,\u201d he continued. \u201cThis is an affront to the First Amendment\nas well as the Second. Even hinting that the killer was motivated in some way\nby an advertising message is so far out in the weeds that it may take a map for\nthe court to find its way back.\u201d<\/p>\n\n\n\n

The Supreme Court has agreed to hear a gun-related case<\/a> this year out of New York City involving a now-repealed statue that prohibited transporting firearms outside city limits. Depending on how broadly the court rules, the case could affect concealed carry laws across the country. <\/p>\n\n\n\n
