{"id":118460,"date":"2019-11-12T15:10:14","date_gmt":"2019-11-12T20:10:14","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=118460"},"modified":"2019-11-12T15:10:14","modified_gmt":"2023-09-06T07:00:52","slug":"bernie-believes-mandatory-buybacks-are-confiscation-unconstitutional","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/bernie-believes-mandatory-buybacks-are-confiscation-unconstitutional\/","title":{"rendered":"Bernie Believes Mandatory &#8216;Buybacks&#8217; Are Confiscation, Unconstitutional"},"content":{"rendered":"\n\n\n\n\n<p><\/p>\n\n\n\n<p>Unlike some of the other 2020 presidential candidates, Bernie Sanders does not support the mandatory \u201cbuyback\u201d of modern sporting rifles.<\/p>\n\n\n\n<p>The Independent senator from Vermont explained to a crowd in Charles City, Iowa, Sunday why \u201cbuybacks\u201d are a no-go for the U.S.&nbsp;<\/p>\n\n\n\n<p>(<strong>Editor&#8217;s note: <\/strong>I\u2019m putting the phrase &#8220;buyback&#8221; in quotes because the term is a misnomer, the government cannot <em>buyback<\/em> something it never possessed in the first place). \u00a0<\/p>\n\n\n\n<p>&#8220;I don&#8217;t support \u2014 a mandatory buyback is essentially confiscation, which I think is unconstitutional,&#8221; said Sanders when asked if he would support such a scheme.<\/p>\n\n\n\n<p>\u201cIt means that I am going to walk into your house and take something whether you like it or not,\u201d he added. \u201cI don&#8217;t think that stands up to constitutional scrutiny.&#8221;<\/p>\n\n\n\n<p>Kudos to Sanders for getting at least that right.&nbsp; You know, though, this is not the first time he\u2019s bucked anti-gun orthodoxy. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/sanders-to-sandy-hook-families-no-i-dont-think-i-owe-them-an-apology\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bernie-believes-mandatory-buybacks-are-confiscation-unconstitutional\" title=\"Bernie Believes Mandatory 'Buybacks' Are Confiscation, Unconstitutional\">Sanders to Sandy Hook Families: \u2018No, I don\u2019t think I owe them an apology\u2019<\/a><\/h2>\n\n\n\n<p>When running against Hillary Clinton in 2016 for the Democratic nomination, Sanders spoke out against repealing the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Protection_of_Lawful_Commerce_in_Arms_Act\" target=\"_blank\" class=\"clickTracking\" campaign=\"bernie-believes-mandatory-buybacks-are-confiscation-unconstitutional\" title=\"Bernie Believes Mandatory 'Buybacks' Are Confiscation, Unconstitutional\">Protection of Lawful Commerce in Arms Act (PLCAA<\/a>), which protects the gun industry from frivolous lawsuits. &nbsp;<\/p>\n\n\n\n<p>Clinton condemned Bernie for his position during a CNN debate, essentially suggesting that he was in the pocket of the gun lobby. &nbsp;<\/p>\n\n\n\n<p>\u201cNow, I voted against this gun liability law [to repeal PLCCA] because I was concerned that in rural areas all over this country, if a gun shop owner sells a weapon legally to somebody, and that person then goes out and kills somebody, I don\u2019t believe it is appropriate that that gun shop owner who just sold a legal weapon to be held accountable and be sued,\u201d said Bernie in response to Clinton\u2019s criticism.&nbsp;<\/p>\n\n\n\n<p>No, this is not to say that Bernie is pro-gun \u2014 far from it.&nbsp; The septuagenarian has called for universal background checks and a ban on so-called \u201cassault rifles\u201d as part of his plan to reduce gun-related violence.&nbsp; <\/p>\n\n\n\n<p>Rather, it\u2019s to simply point out that if people on the Left were to be intellectually honest about buybacks and suing gun manufacturers or sellers for the acts of criminals, they&#8217;d have no choice but to reach the same conclusions Bernie did.  <\/p>\n\n\n\n<p>Another way to look at it is if a Democratic socialist like Berne Sanders believes these gun-control policies are too extreme &#8212; they must be, right?
