(Photo: Andrew Cuomo Facebook)<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The SAFE Act hasn\u2019t done New York gun owners any favors, but its draconian anti-gun policies just opened 5,300 acres of hunting lands that had previously been in shaky legal territory. <\/p>\n\n\n\n<p>Gov. Andrew Cuomo recently signed an amendment to legislation that accompanied the SAFE Act that allows the State University of New York College of Environmental Science and Forestry (SUNY ESF) to re-open 5,300 acres of hunting ground in the Adirondacks. The amendment took effect on October 17, just in time for deer hunting season in the Northern Zone.<\/p>\n\n\n\n<p>&#8220;I have heard from a number of sportsmen and woman who wish to see hunting restored in that area and I am pleased that this amendment was signed by the Governor,\u201d Assemblyman Will Barclay, R-Pulaski, who co-sponsored the bill, told <em><a href=\"https:\/\/www.newyorkupstate.com\/outdoors\/2019\/10\/cuomo-signs-bill-opening-5300-acres-of-adirondack-land-to-hunting-with-firearms.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-safe-act-5300-acres-legal-hunting-ground\" title=\"Something Good from the SAFE Act? Anti-Gun Bill Leads to 5,300 Acres of Legal Hunting Ground\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">New York Upstate<\/a><\/em>. <\/p>\n\n\n\n<p>The SAFE Act didn\u2019t open new hunting grounds by itself. In\nfact, when it passed in 2013, it closed lands that had previously been enjoyed\nby SUNY ESF\u2019s students and faculty, along with the general public. <\/p>\n\n\n\n<p>But a little-known portion of the law prompted SUNY ESF\u2019s administrators to take a closer look at the policies governing their use of the 2,500-acre Pack Forest Demonstration Area and the 2,800-acre Dubuar Memorial Forest\u2014which in turn prompted lawmakers to correct a serious oversight in the law. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/hunt365-ted-nugent-michigan-deer-baiting-ban\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-safe-act-5300-acres-legal-hunting-ground\" title=\"Something Good from the SAFE Act? Anti-Gun Bill Leads to 5,300 Acres of Legal Hunting Ground\">Ted Nugent Weighs in on the Michigan Deer Baiting Ban: \u201cEngineered Ruination of Our Hunting Heritage\u201d<\/a> <\/h2>\n\n\n\n<p>SUNY ESF had for decades allowed hunting on the 5,300-acre\nportion of land owned by Syracuse University and held in trust for SUNY. A law\nhad been passed prior to the SAFE Act that charged violators who criminally\npossessed a firearm on school and college\/university properties with a\nmisdemeanor. The original law exempted land \u201cowned and maintained\u201d by SUNY ESF,\nbut that exemption didn\u2019t technically apply to the portion of the land in\nquestion.<\/p>\n\n\n\n<p>\u201cThe law that was originally used to try and craft the\nexemption for SUNY was flawed. It covered land \u2018owned and maintained\u2019 by SUNY\nESF. That\u2019s the key phrase, \u2018owned and maintained.\u2019 Our Adirondack property is\nowned by Syracuse University and held in trust for us. We don\u2019t own it,\u201d Robert\nDavis, former director of forest properties for SUNY ESF, told <em>New York Upstate<\/em>.<\/p>\n\n\n\n<p>The error wasn\u2019t corrected until the SAFE Act increased the charge for criminally possessing a firearm on school property from a misdemeanor to a Class E felony. The state legislature decided to fix the oversight exposed by the SAFE Act and amended the Penal Code to include the words \u201cheld in trust\u201d in SUNY ESF\u2019s exemption.
