BELLEVUE, WA \u2013<\/strong> The Second Amendment Foundation has joined four other organizations in an amicus curiae brief to the U.S. Supreme Court supporting a challenge to Maryland\u2019s restrictive gun control law requiring applicants for concealed carry permits to provide a \u201cgood and substantial reason\u201d to exercise their right to bear arms.<\/p>\n\n\n\n SAF\nis joined by the Firearms Policy Coalition, Inc. (\u201cFPC\u201d), Firearms Policy\nFoundation, California Gun Rights Foundation and the Madison Society\nFoundation. Their brief is submitted to the high court by Sacramento attorney\nJoseph G.S. Greenlee.<\/p>\n\n\n\n The\ncase is known as Malpasso v. Pallozzi<\/em>.\nPlaintiffs are Brian Kirk Malpasso and the Maryland State Rifle and Pistol\nAssociation.<\/p>\n\n\n\n \u201cThis\ncase could have far-reaching ramifications,\u201d noted SAF founder and Executive\nVice President Alan M. Gottlieb. \u201cAt issue is Maryland\u2019s restrictive\nrequirement but the outcome, if the Court agrees to hear this case, could\ndefine the parameters of bearing arms outside the home, and that will impact\nrestrictive laws in several states where carry permits or licenses are strictly\nregulated, which translates to nearly impossible to get.\u201d<\/p>\n\n\n\n The\namicus brief asks the high court to determine \u201cto what extent the right to bear\narms applies beyond the home,\u201d because the question \u201chas deeply divided lower\ncourts.\u201d The 27-page brief notes that the D.C. and Seventh Circuits held that\nthe right applies just as strongly outside the home as inside the home, while\nthe First and Second Circuits determined that the right likely applies outside\nthe home, but in a weaker form. Meanwhile, the Third and Fourth Circuits\ndeclined to decide whether the right exists outside the home and the Ninth and\nTenth Circuits held that the right to bear arms does not protect concealed\ncarry.<\/p>\n\n\n\n \u201cClearly,\u201d Gottlieb said, \u201cthe lower courts need definitive guidance on this important constitutional issue. What other constitutionally-enumerated fundamental right applies only within the confines of the home?
