(Photo: Bill Peduto Facebook)<\/em> <\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>A Pennsylvania judge ruled this week that Pittsburgh\u2019s anti-gun laws are \u201cvoid and unenforceable\u201d because state preemption statues prohibit local governments from restricting firearm possession and use. &nbsp;<\/p>\n\n\n\n<p>\u201cStated simply, under the doctrine of field preemption, the Uniform Firearms Act preempts any local regulation pertaining to the regulation of firearms,\u201d Allegheny Court of Common Pleas Judge Joseph M. James said in his <a href=\"https:\/\/d3n8a8pro7vhmx.cloudfront.net\/firearmspolicycoalition\/pages\/5237\/attachments\/original\/1572377686\/2019-10-29-pittsburgh-judgment.pdf?1572377686\" target=\"_blank\" class=\"clickTracking\" campaign=\"pennsylvania-judge-pittsburgh-anti-gun-laws-void-and-unenforceable\" title=\"Pennsylvania Judge Rules Pittsburgh\u2019s Anti-Gun Laws 'Void and Unenforceable'\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">opinion<\/a>. Three anti-gun Pittsburgh ordinances are therefore \u201cvoid and unenforceable due to field preemption by the Legislature.\u201d <\/p>\n\n\n\n<p>The Pittsburgh city council voted in April to pass three\nlaws that restricted the \u201cuse\u201d of semi-automatic rifles within city limits, banned\nmagazines capable of holding more than ten rounds, and allowed courts to seize\nfirearms under \u201cextreme risk protection orders.\u201d<\/p>\n\n\n\n<p>Pennsylvania law prohibits municipalities from passing\nordinances that contradict state regulations, but Pittsburgh city officials\nattempted to get around this prohibition by banning the \u201cuse\u201d of semi-automatic\nrifles rather than the \u201cpossession.\u201d<\/p>\n\n\n\n<p>Judge James flatly rejected the city\u2019s argument. He noted\nthat the state Supreme Court ruled in 2009 that if the state legislature passes\na law that obviously intends to regulate an entire \u201cfield,\u201d local governments\ncannot pass any measures that restrict that field in any way. Because the state\u2019s\nUniform Firearms Act clearly intends to preempt all firearm-related laws, it\ndoesn\u2019t matter whether Pittsburgh\u2019s ordinance regulates the \u201cuse\u201d or \u201cpossession\u201d\nof semi-automatic rifles. &nbsp;<\/p>\n\n\n\n<p>\u201cDespite the City&#8217;s efforts to avoid the specific preemption set forth in \u00a7 6120, they are not able to avoid the obvious intent of the Legislature to preempt this entire field. The UFA purports to regulate firearms and ammunition in the Commonwealth whether a person is using, brandishing, carrying or loading them,\u201d James said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/nevada-sheriff-will-enforce-gun-confiscation-law-recall\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pennsylvania-judge-pittsburgh-anti-gun-laws-void-and-unenforceable\" title=\"Pennsylvania Judge Rules Pittsburgh\u2019s Anti-Gun Laws 'Void and Unenforceable'\">Nevada Sheriff Will Enforce Gun Confiscation Law, Faces Recall<\/a><\/h2>\n\n\n\n<p>Three individuals along with the Firearms Policy Coalition,\nFirearms Policy Foundation, and Firearms Owners Against Crime filed the suit\nagainst the City, Mayor Bill Peduto, and the six city council members who voted\nfor the ordinance. <\/p>\n\n\n\n<p>&#8220;I am delighted that Judge James&#8217; decision today\nappropriately struck down the City of Pittsburgh&#8217;s unlawful firearm ordinances\nand signage,&#8221; plaintiffs&#8217; attorney Joshua Prince said in a statement.\n&#8220;The City&#8217;s gun control sought to eviscerate the inviolate right of the\nresidents of the Commonwealth to keep and bear arms and ensnare law-abiding\ncitizens through a patchwork of laws.
