However, it\u2019s not my job to oppose a law; my job is to enforce the law.\u201d<\/p>\n\n\n\n<p>Proponents of the recall believe that Allen should follow in the footsteps of Humboldt County commissioners, who on Oct. 7, passed a \u201cSecond Amendment sanctuary\u201d resolution that explicitly states, \u201cNeither the United States Congress nor the Nevada legislature should entertain consideration of any legislation that would infringe on constitutionally protected rights under the Second Amendment.\u201d<\/p>\n\n\n\n<p>But Allen told <a href=\"https:\/\/www.breitbart.com\/politics\/2019\/10\/28\/nevada-sheriff-facing-recall-his-plans-enforce-red-flag-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-sheriff-will-enforce-gun-confiscation-law-recall\" title=\"Nevada Sheriff Will Enforce Gun Confiscation Law, Faces Recall\">Breitbart News<\/a> that his hands are tied on the matter. &nbsp;<\/p>\n\n\n\n<p>\u201cWhere in the U.S. Constitution, or the Nevada constitution, can I pick and choose what laws I enforce?\u201d he asked, adding, \u201cThere\u2019s no legal basis for the sanctuary declaration, for a sanctuary basis.\u201d<\/p>\n\n\n\n<p>The sheriff did say that he\u2019s \u201cnever violated anybody\u2019s constitutional rights, nor will I\u201d and that he supports the 2A and everyone\u2019s constitutional rights. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a href=\"https:\/\/www.gunsamerica.com\/truth-about-red-flag-laws\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-sheriff-will-enforce-gun-confiscation-law-recall\" title=\"Nevada Sheriff Will Enforce Gun Confiscation Law, Faces Recall\">Exclusive: \u2018Sending People Home To Die,\u2019 The Truth About Red Flag Laws<\/a><\/h2>\n\n\n\n<p>But if the red flag law is unjust or unconstitutional, and Allen opts to enforce it, as he plans on doing, wouldn\u2019t that undermine his claim that he would never violate one\u2019s right to keep and bear arms? \u00a0<\/p>\n\n\n\n<p>Moreover, how exactly does he plan on seizing firearms when one has been flagged? \u00a0<\/p>\n\n\n\n<p>On that second question, concerns have been raised about SWAT-team-type raids.<\/p>\n\n\n\n<p>\u201cWhat the questioning was is, \u2018[Do] you get a SWAT team to go into the house?\u2019 We do whatever we do to make it as safe as possible. And if what\u2019s as safe as possible is to wait for that individual to leave the house, then that\u2019s what we\u2019ll do,\u201d Allen explained. \u201cMost of the time there will be other laws that we\u2019ll be able to apply.\u201d<\/p>\n\n\n\n<p>Hmmm.\u00a0 Maybe they&#8217;ll wait for the homeowner to leave before they confront him.  Maybe they won&#8217;t.  But we do know how agencies in other states conduct their gun-seizing operations. Oftentimes, tactical teams deploy in the pre-dawn hours of the day to catch the accused off guard.\u00a0 Why?\u00a0 Because that\u2019s the safest approach for the officers \u2014 not the homeowner. \u00a0<\/p>\n\n\n\n<p>One person has already been slain as a result of a red flag order.\u00a0 A <a href=\"https:\/\/www.gunsamerica.com\/shoot-confiscate-firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-sheriff-will-enforce-gun-confiscation-law-recall\" title=\"Nevada Sheriff Will Enforce Gun Confiscation Law, Faces Recall\">61-year-old Baltimore man was fatally shot by law enforcement <\/a>after police attempted to seize his guns on Nov. 5, 2018, at around 5:17 a.m. The man\u2019s niece was confused by the incident, chalking up the initial red flag order against the man as \u201cfamily being family.\u201d\u00a0<\/p>\n\n\n\n<p>\u201cI\u2019m just dumbfounded right now,\u201d she told local media. \u201cMy uncle wouldn\u2019t hurt anybody. They didn\u2019t need to do what they did.\u201d<\/p>\n\n\n\n<p>Maybe Sheriff Allen will be more judicious when it comes to enforcing Nevada\u2019s red flag law.&nbsp; Maybe he\u2019ll go the extra mile to ensure that the target is truly a threat to herself\/himself or others.&nbsp; Or maybe he\u2019ll just follow orders, come what may.&nbsp; &nbsp; &nbsp;<\/p>\n\n\n\n<p>After filing the petition to recall Sheriff Allen, those pushing for a recall will have 90 days to collect 502 signatures.&nbsp; Should they succeed, their grievance will be reviewed before a recall committee. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"text-align:center\">***<a href=\"https:\/\/gunsamerica.com\/\" campaign=\"BuySellGA_Register\" target=\"_blank\" class=\"clickTracking\">Buy and Sell on GunsAmerica!<\/a>*** <\/h2>\n","protected":false},"excerpt":{"rendered":"<p>\u201cThey\u2019re taking up a fight against me on something the Legislature has to do, and they think I have the authority not to follow the law,\u201d Allen said last Wednesday. \u201cI do oppose this law.
