The plaintiffs argued that the ATF\u2019s decision violated their Fifth Amendment rights and they were seeking $500,000 as compensation for their lost property.<\/p>\n\n\n\n<p>Loren A Smith, a senior circuit judge for a federal court in\nWashington, D.C., dismissed the suit, arguing that because the ATF was\nexercising its \u201cpolice powers\u201d in its bump stock decision, the Fifth Amendment\u2019s\nTaking Clause does not apply.&nbsp;<\/p>\n\n\n\n<p>\u201cThe law is different in this case because the government, as the sovereign, has the power to take property that is dangerous, diseased, or used in criminal activities without compensation,\u201d Smith wrote in a <a href=\"https:\/\/ecf.cofc.uscourts.gov\/cgi-bin\/show_public_doc?2019cv0449-13-0\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-rules-no-compensation-companies-destroy-75000-bump-stocks\" title=\"Court Rules No Compensation for Companies Forced to Destroy 75,000 Bump Stocks\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">nine-page ruling<\/a>. \u201cHere, ATF acted properly within the confines of the limited federal police power.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/watch-as-60000-bump-stocks-are-destroyed\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-rules-no-compensation-companies-destroy-75000-bump-stocks\" title=\"Court Rules No Compensation for Companies Forced to Destroy 75,000 Bump Stocks\">Watch as 60,000 Bump Stocks Are Destroyed<\/a> <\/h2>\n\n\n\n<p>The judge expressed sympathy for the plaintiffs and\nacknowledged that his ruling would have been different if legally-possessed firearms\nhad been confiscated by persons not committing a crime. But because, according\nto Smith, machineguns are not protected under the Second Amendment and the\nTakings Clause does not apply to property \u201cinjurious to the health, morals, or\nsafety of the community,\u201d bump stocks can be confiscated without fair compensation.<\/p>\n\n\n\n<p>The ATF has waffled for decades on how the federal restrictions on machinegun ownership apply to bump stocks. In 2006, the agency determined that a type of bump stock device known as the Akins Accelerator constituted a machinegun and was thus subject to the National Firearms Act and the Firearm Owners Protection Act. <\/p>\n\n\n\n<p>In subsequent years, however, the ATF determined that\nsimilar (though not identical) devices did not meet the definition of\nmachinegun.
