Democratic Wisconsin Governor Tony Evers announced this week his intention to call a special legislative session to compel state legislators to pass a \u201cred flag\u201d law and a universal background check bill. <\/p>\n\n\n\n

The move was met with staunch opposition by House and Senate\nRepublicans, who control the legislature and are under no obligation to\nconsider any of the governor\u2019s proposals. <\/p>\n\n\n\n

That hasn\u2019t stopped Gov. Evers from his crusade \u2013 and from threatening to call a special session as many times as it takes to force Republicans to act, according to the Journal Sentinel<\/a>. <\/p>\n\n\n\n

The governor has described Republicans as going against the will of their constituents after a University of Marquette Law School poll<\/a> seemingly indicated broad support for universal background checks and so-called red flag laws.  <\/p>\n\n\n\n

“How many times can you go against 80% of the people of the state of Wisconsin … essentially telling them to go to hell and expect to be re-elected?” Evers said<\/a> Monday. “It doesn\u2019t make sense to me.\u201d<\/p>\n\n\n\n

Evers, along with much of the mainstream media coverage, fails\nto mention that the poll questions do not encompass the scope of the policy\nproposals. <\/p>\n\n\n\n

The universal background check bill<\/a> put forward by Wisconsin Democrats only allows private transfers between \u201cfamily members,\u201d but it defines \u201cfamily\u201d as \u201cspouse, parent, grandparent, sibling, child, or grandchild.\u201d The bill also only allows firearms to be \u201cgifted, bequested, or inherited\u201d without a background check. If the firearm is sold, the purchaser must pass a check, no matter the relationship with the seller.<\/p>\n\n\n\n

The Marquette survey question mentions none of this. It only\naskes, \u201cDo you support or oppose making private gun sales and sales at gun\nshows subject to background checks?\u201d<\/p>\n\n\n\n

The red flag question similarly misrepresents the actual language of the legislation. It asks, \u201cWould you support or oppose a law allowing the police to take guns away from people who have been found by a judge to be a danger to themselves or others?\u201d<\/p>\n\n\n\n

The bill<\/a>, by contrast, would also allow family or household members to request that a person\u2019s guns be confiscated. In addition, \u201cfound by a judge\u201d hides the fact that the judge\u2019s ruling can come without a hearing. Under the legislation, a person\u2019s firearms can be confiscated simply by obtaining a judge\u2019s signature. <\/p>\n\n\n\n

Wisconsin Republicans don\u2019t appear to be taking Evers\u2019 bait.\nThey\u2019ve indicated their plan to end the special session as soon as it begins. <\/p>\n\n\n\n

“Liberals across the country are upping their rhetoric\nin support of taking guns from law-abiding citizens,” Senate Majority\nLeader Scott Fitzgerald said in a statement. “The Senate will not be part\nof a drawn-out strategy to infringe on constitutional rights.\u201d  <\/p>\n\n\n\n

Assembly Speaker Robin Vos said the proposals infringe on\nSecond Amendment rights.<\/p>\n\n\n\n

\u201cA special session call will not change where my Assembly\nRepublican colleagues and I stand on protecting the 2nd Amendment rights of\nWisconsin citizens,” Vos said. “As I have repeatedly said, we will\nnot entertain proposals that infringe on our constitutional rights.” <\/p>\n\n\n\n

Republican leaders are especially wary of Evers\u2019 intentions\nafter the governor mentioned he\u2019d \u201cconsider\u201d a mandatory buyback of so-called \u201cassault\nweapons.\u201d Assembly leaders see the governor\u2019s special session as a way to\nadvance that agenda. <\/p>\n\n\n\n

“Today\u2019s call is another indication that Governor Evers\nstands ready to confiscate guns in our state,” Vos said.<\/p>\n\n\n\n

This isn\u2019t the first time this year a Democratic governor has called a special session for a Republican-controlled legislature to consider gun control policies. Virginia Governor Ralph Northam called a special session earlier this year to consider a full slate of gun control proposals, but Republicans ended it<\/a> after less than two hours. <\/p>\n\n\n\n

By all indications, Gov. Evers’ special session will meet with a similar fate.<\/p>\n\n\n\n
