In a separate case, filed by SAF and NRA against the\nCity of Seattle in neighboring King County, a different judge ruled the\nopposite. That case is now before the State Court of Appeals. <\/p>\n\n\n\n<p>\u201cWe\u2019re\nencouraged by the judge\u2019s ruling,\u201d said SAF founder and Executive Vice\nPresident Alan M. Gottlieb. \u201cJudge Farris\u2019 ruling confirms what we\u2019ve argued\nall along, that under the state preemption law, first adopted in 1983 and\nstrengthened in 1985, the Legislature has sole authority over firearms\nregulation in the state.\u201d<\/p>\n\n\n\n<p>The\npreemption statute is designed to create statewide uniformity in firearms\nregulation, he noted. Allowing municipalities to chip away at the law by adding\na storage requirement simply cannot be permissible, he added. <\/p>\n\n\n\n<p>The\njudge denied the city\u2019s request in the SAF\/NRA summary judgment victory to stay\nthe decision until it can be appealed. Gottlieb noted that Judge Farris was\nhaving none of it. The judge explained that part of the \u201cstay test\u201d requires\nshowing a reasonable probability of success on the merits, and she saw no\npossibility of success for the city on appeal. She described it as \u201cnot a close\ncall.\u201d<\/p>\n\n\n\n<p>\u201cMichael\nBloomberg\u2019s gun control lobbying group has been supporting similar restrictive\nlocal laws all over the country,\u201d Gottlieb stated. \u201cThis victory will help stop this across the country. Preemption\nuniformity was a good idea in the 1980s and it is still the most commonsense\nway to deal with firearms regulation,\u201d Gottlieb observed. \u201cWhat is the law in\none part of a state should be the law in all parts of that state.\u201d<\/p>\n\n\n\n<p>Under\nthe judge\u2019s order, pending appeal, a permanent injunction will take effect\nagainst the Edmonds storage ordinance, and if an appeal is unsuccessful, that\nrequirement must be repealed. <\/p>\n\n\n\n<p>Plaintiffs\nare represented by attorneys Stephen Fogg and Eric Lindbergh with Corr Cronin\nLLP of Seattle.<\/p>\n\n\n\n<p>The Second Amendment\nFoundation (www.saf.org) is the nation\u2019s oldest and largest tax-exempt\neducation, research, publishing and legal action group focusing on the\nConstitutional right and heritage to privately own and possess firearms.&nbsp;
