<\/p>\n\n\n\n

Stephen Nichols wasn\u2019t convicted of a crime. No judge signed a \u201cred flag\u201d order. There wasn\u2019t even a hearing. Nichols\u2019 constitutional rights were stripped and his firearms confiscated after an out-of-context comment was overheard by a waitress at a local diner.<\/p>\n\n\n\n

Tisbury, Ma., Police Chief Mark Saloio seized the\n84-year-old\u2019s firearms\u2014and fired him from his job as a crossing guard\u2014after\nreceiving a tip from a diner employee. The waitress had heard Nichols complain\nthat the Tisbury School resource officer had been \u201cleaving his post\u201d and\nvisiting a nearby convenience store while the children were filing into class. <\/p>\n\n\n\n

In that conversation, Nichols told a friend that someone\ncould \u201cshoot up the school\u201d in that officer\u2019s absence. <\/p>\n\n\n\n

That\u2019s all it took. <\/p>\n\n\n\n

Chief Saloio fired Nichols from his job as a crossing guard\nwhile Nichols was helping kids cross the street and told him that what he said\nwas a \u201cfelony.\u201d<\/p>\n\n\n\n

\u201cHe came up and told me what I said was a felony but he wasn\u2019t going to charge me,\u201d Nichols told the MV Times<\/a>. <\/p>\n\n\n\n

Saloio later drove to Nichols\u2019 house and demanded that he\nhand over his license to own firearms. The police chief confiscated the man\u2019s\nfirearms, which were subsequently turned over to Nichols\u2019 son-in-law. Nichols\nsays he never received any paperwork or receipts for his confiscated license or\nfirearms.  <\/p>\n\n\n\n

He clarified the comments he made in an interview with the MV Times.<\/p>\n\n\n\n

\u201cWhen I was in the United States Army, and it wasn\u2019t just\nme, it\u2019s anybody who\u2019s in the United States service, if you are on guard duty\nfor eight hours, you didn\u2019t leave that position,\u201d Nichols said. \u201cAnd I\u2019m just\nso accustomed to that, that when I see someone who\u2019s suppose to be protecting\nkids\u2026leave the school unguarded \u2014 if you\u2019re on guard duty, you stay there.\u201d<\/p>\n\n\n\n

Those who heard Nichols\u2019 comments and who know him say the\nidea that he would threaten to harm children is patently false. <\/p>\n\n\n\n

The diner\u2019s owner, Marc Hanover, called the situation\n\u201cabsolutely outrageous.\u201d He said he believes one of his servers \u201coverreacted.\u201d <\/p>\n\n\n\n

The man who was speaking with Nichols, Andy Marcus, also described\nthe situation as \u201cabsurd.\u201d Marcus told the MV Times that Nichols did not\nthreaten the school but was worrying that the resource officer was leaving the\nchildren potentially exposed. <\/p>\n\n\n\n

The police department and local government have refused to\ncomment on the situation, and requests for the police report have been stonewalled.<\/p>\n\n\n\n

\u201cThere\u2019s nothing that I can legally discuss about the\nmatter. Period,\u201d Chief Saloio told the MV Times.<\/p>\n\n\n\n

Town administrator Jay Grande confirmed that Nichols had\nbeen removed as a crossing guard but wouldn\u2019t comment further.<\/p>\n\n\n\n

\u201cIn response to your inquiry, I want to acknowledge that a\ncrossing guard was removed from active status pending a review of personnel\nrelated concerns,\u201d he wrote. \u201cI will not have any further comment on this\nmatter.\u201d<\/p>\n\n\n\n

Nichols has retained a lawyer but appears unconvinced that\nhe\u2019ll be successful in restoring his Second Amendment rights. <\/p>\n\n\n\n

\u201cMy grandson is manager of a gun shop in Worcester, Mass and he\u2019s going to be allowed to come down and take the weapons and sell them for me,\u201d he told the MV Times. <\/p>\n\n\n\n

Nichols served as a Tisbury police officer for six decades\nand in the United States Army during the Korean War. He\u2019s also been licensed to\nown firearms since 1958 and has never committed any firearms violations. <\/p>\n\n\n\n

More importantly, he wants his community to know that he\nwould never threaten kids. <\/p>\n\n\n\n

\u201cI would never, ever, ever, harm a child,\u201d he said. <\/p>\n\n\n\n

Update (10\/17\/19): <\/strong>Nichols has been reinstated as a crossing guard, according to the MV Times. The newspaper reported that the story garnered “never before seen” activity on the paper’s webpages, and Chief Saloio noted the “outpouring of support” in his statement to the paper: <\/p>\n\n\n\n

\u201cThe town, collectively, has expressed an outpouring of concern about Mr. Nichols, and his employment as a school crossing guard. We as well share those concerns. We wish to make you aware that today, Mr. Nichols was informed that he may return to his crossing guard duties tomorrow morning,\u201d Saloio wrote in an email to The Times. \u201cThis return to work was always pending upon a final review that was in process. Throughout this period, Mr. Nichols has retained his position as a crossing guard for the town. However, these reviews are thorough and complete, and neither immediate nor instantaneous.\u201d <\/p>\n\n\n\n

There is no word on whether Nichols will have his firearms and license returned. <\/p>\n\n\n\n
