{"id":116866,"date":"2019-10-10T14:25:06","date_gmt":"2019-10-10T18:25:06","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=116866"},"modified":"2019-10-10T14:25:06","modified_gmt":"2023-09-06T05:07:18","slug":"felony-charge-for-12-year-old-girl-giving-pistol-fingers-in-class","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/felony-charge-for-12-year-old-girl-giving-pistol-fingers-in-class\/","title":{"rendered":"Felony Charge for 12-Year-Old Girl Giving Pistol Fingers in Class"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>A Kansas girl was arrested last month and charged with a felony for giving pistol fingers in class, local media reports.<\/p>\n\n\n\n<p>The girl, a student at Westridge Middle School in Overland Park, was allegedly responding to a classmate\u2019s question on if she could kill five people in the room who would they be? &nbsp;<\/p>\n\n\n\n<p>With her fingers in the shape of a gun, the 12-year-old girl pointed to several students, a source familiar with the details of the incident told the <a href=\"https:\/\/www.kansascity.com\/news\/local\/crime\/article235891762.html?\" target=\"_blank\" class=\"clickTracking\" campaign=\"felony-charge-for-12-year-old-girl-giving-pistol-fingers-in-class\" title=\"Felony Charge for 12-Year-Old Girl Giving Pistol Fingers in Class\">Kansas City Star<\/a>.\u00a0<\/p>\n\n\n\n<p>The student was sent to the principal\u2019s office where a student resource officer with the Overland Park Police Department suggested that she be taken into custody.&nbsp; The girl was then hauled out in handcuffs.&nbsp;<\/p>\n\n\n\n<p>The Johnson County District Attorney\u2019s Office charged her with felony threatening.&nbsp;<\/p>\n\n\n\n<p>Court documents filed on Sept. 18, state she \u201cunlawfully and feloniously communicated a threat to commit violence, with the intent to place another, in fear, or with the intent to cause the evacuation, lock down or disruption in regular, ongoing activities \u2026\u201d&nbsp; or created just the risk of causing such fear, reports the Kansas City Star. &nbsp;<\/p>\n\n\n\n<p>A spokesperson for the Shawnee Mission School District was adamant that although the gesture might violate the school\u2019s policy on intimidation and bullying, the decision to place the girl under arrest came from the police department, not from school nor district officials. \u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/new-york-teachers-starts-hunger-strike-for-black-rifle-ban-gun-control\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"felony-charge-for-12-year-old-girl-giving-pistol-fingers-in-class\" title=\"Felony Charge for 12-Year-Old Girl Giving Pistol Fingers in Class\">New York Teachers Starts Hunger Strike for Black Rifle Ban, Gun Control<\/a><\/h2>\n\n\n\n<p>&#8220;I want to be very clear: The arrest of this student was wholly unrelated to any district policy. It was a municipal police department decision, and our policies don&#8217;t impact police department decisions,\u201d said spokesperson Dave Smith in an email to <a href=\"https:\/\/www.kshb.com\/news\/local-news\/overland-park-student-arrested-for-pointing-finger-gun-at-other-students\" target=\"_blank\" class=\"clickTracking\" campaign=\"felony-charge-for-12-year-old-girl-giving-pistol-fingers-in-class\" title=\"Felony Charge for 12-Year-Old Girl Giving Pistol Fingers in Class\">KSHB.com<\/a>. \u00a0<\/p>\n\n\n\n<p>Meanwhile, the girl\u2019s grandfather believes the entire incident has been blown out of proportion. &nbsp;<\/p>\n\n\n\n<p>\u201cI think that this is something that probably could have been handled in the principal\u2019s office and got completely out of hand,\u201d said Jon Cavanaugh, the student\u2019s grandpa.&nbsp;<\/p>\n\n\n\n<p>Cavanaugh said the girl does not have access to firearms nor does she want to harm anyone. \u00a0 \u201cShe was just mouthing off,\u201d he explained. \u00a0<\/p>\n\n\n\n<p>It doesn\u2019t appear that prosecutors are backing down, though.\u00a0 The student is scheduled to appear at the Juvenile Division of the District Court of Johnson County on Tuesday. \u00a0<\/p>\n\n\n\n<p>If convicted of the felony offense, the girl may spend up to a year in a juvenile detention facility, according to Cavanaugh.\u00a0 Not to mention that being a convicted felon may prevent her from joining the military, voting, going to certain colleges, etc.  \u00a0<\/p>\n\n\n\n<p>\u201cI\u2019m really worried about my granddaughter\u2019s future,\u201d he said.\u00a0<\/p>\n\n\n\n<div class=\"scripps_iframe_embed\" style=\"position:relative\"><div style=\"width:100%;height:auto;padding-bottom:56.25%\"><\/div><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"text-align:center\">***<a href=\"https:\/\/gunsamerica.com\/\" campaign=\"BuySellGA_Register\" target=\"_blank\" class=\"clickTracking\">Buy and Sell on GunsAmerica!<\/a>***<\/h2>\n","protected":false},"excerpt":{"rendered":"<p>A Kansas girl was arrested last month and charged with a felony for giving pistol fingers in class, local media reports.
