<\/p>\n\n\n\n

The Supreme Court announced this week that it will hear oral arguments in a case challenging a New York City law that prohibited residents from transporting firearms outside city limits.<\/p>\n\n\n\n

City officials repealed the ordinance earlier this year to\navoid a pro-gun Supreme Court decision and have since argued that the Court\nshould not hear the case because the issue is now moot. On Monday, the Court disagreed.<\/p>\n\n\n\n

\u201cThe Respondents\u2019 Suggestion of Mootness is denied,\u201d the Court said<\/a>. \u201cThe question of mootness will be subject to further consideration at oral argument, and the parties should be prepared to discuss it.\u201d<\/p>\n\n\n\n

The case is backed by the National Rifle Association and the New York Rifle and Pistol Association. The NRA applauded the Court\u2019s decision in a press release<\/a>. <\/p>\n\n\n\n

“The Supreme Court saw through New York City’s blatant\nattempt to evade judicial review in this important case,\u201d said NRA-ILA\nExecutive Director Jason Ouimet. \u201cThis case presents a national opportunity to\nconfirm a simple truth that New York City politicians refuse to accept: Our\nSecond Amendment right to keep and bear arms is fundamental, and it doesn\u2019t\nvanish when we exit our homes.\u201d<\/p>\n\n\n\n

The Court has faced significant political pressure in recent months to drop the case. Five Democratic Senators, backed by 139 House Democrats<\/a>, issued a brief<\/a> in August threatening to \u201crestructure\u201d the Court if it chose to move forward. The senators accused the Court of \u201cpartnering\u201d with \u201cthe NRA and its allies\u201d:<\/p>\n\n\n\n

\u201cParticularly in an environment where a growing majority of\nAmericans believes this Court is \u2018motivated mainly by politics,\u2019 rather than by\nadherence to the law, the Court should resist petitioners\u2019 invitation,\u201d they\nsaid.<\/p>\n\n\n\n

Attorneys for the plaintiffs argued<\/a> that the case is not moot because, as Second Amendment Foundation Founder Alan Gottlieb told<\/a> GunsAmerica in August, New York City can simply reinstate the law the moment the Court agrees to drop the case. This issue is not moot, in other words, until the plaintiffs receive a ruling from the highest court in the land.<\/p>\n\n\n\n

\u201cAs petitioners have explained, they manifestly have not\nobtained everything from the unilateral and begrudging changes in city and\nstate law that they could have gotten were this case litigated to a favorable\nresult, with declaratory relief that the transport ban is (and always was)\nunconstitutional and binding, forward-looking injunctive relief,\u201d the plaintiffs\u2019\nlawyers said.<\/p>\n\n\n\n

A wide variety of pro-gun organizations have filed briefs in\nsupport of the plaintiffs, including the National African American Gun\nAssociation, the Pink Pistols, the Liberal Gun Club, the Cato Institute, and\nthe Academics for the Second Amendment. <\/p>\n\n\n\n

One hundreds and twenty members of the U.S. House also filed a brief in support, arguing<\/a> that the right to keep and bear arms in \u201cis an individual, natural, and fundamental right\u201d that \u201cpredates the Second Amendment, and its central concept is the right of self-defense.\u201d<\/p>\n\n\n\n

The Court will hear the first oral arguments on Monday, December 2, 2019. <\/p>\n\n\n\n
