We all want to protect ourselves and our loved ones, especially when we are in our own homes. I\u2019ve always disliked the term \u201chome defense\u201d because, in reality, it\u2019s not the structure we are defending but rather the people inside. By making the right choices, we can protect ourselves legally and avoid ending up in prison or being bankrupted in a lawsuit.<\/p>\n\n\n\n

You\u2019ve probably heard someone express the rather simplistic\nnotion that \u201cif a guy\u2019s in your house, you can shoot him, no question.\u201d As with\njust about any legal quandary, it depends. True, juries have a bit more\nsympathy for someone who is attacked in his or her own home than they do if an\nindividual uses deadly force in public, but don\u2019t think that the fundamental\nrules of self-defense suddenly evaporate. A number of high-profile cases over the\nlast couple of years have resulted in homeowners who claimed self-defense being\nconvicted of aggravated assault, manslaughter or first-degree murder. And even\nwhen no criminal charges were filed, civil lawsuits have cost people their life\nsavings, some even losing the very homes they tried to protect.<\/p>\n\n\n\n

By the way, people often erroneously call anyone who breaks\ninto a house a \u201cburglar.\u201d But a burglar is a thief. A professional burglar will\noften case neighborhoods for homes that are unoccupied during the day, which is\nwhen most burglaries occur. A burglar only wants your stuff. What he or she\ndoes not want is a confrontation, particularly with an angry homeowner who\nmight be armed. The only time you are likely to confront a burglar is by\naccident \u2014 when he or she thought the home was unoccupied.<\/p>\n\n\n\n

This is exactly what happened to a student of mine who\nstayed home from work one day to do some chores around the house. Afterward,\nwhen he got out of the shower, he heard a noise. As he stepped out of his\nbedroom wearing only a bath towel, he came face to face with two very shocked\nyoung men, who immediately scrambled out the back door, dropping all the stuff\nthey\u2019d been carrying. Lucky for everyone.<\/p>\n\n\n\n

Home invaders, on the other hand, are truly the stuff of\nnightmares. Unlike burglars, these are individuals who break into a dwelling\nexpecting, even hoping, to find you home. Think rapists, violent sadists and\neven the \u201cthrill killers\u201d portrayed on those true-crime TV shows. These\nperpetrators are likely armed \u2014 if not with guns, then with knives, bats or\nother weapons of opportunity.<\/p>\n\n\n\n

A word of warning though: Before you pull the trigger, you\u2019d\nbetter be sure. Not everyone who ends up in your home, even in the middle of\nthe night, is necessarily a genuine threat. People have unintentionally shot\ndrunken neighbors, kids playing pranks, spouses and, worst of all, their own\nchildren. Just last year in Central Florida, a man unintentionally shot his\n17-year-old son who was coming home late at night and was trying not to wake\nhis parents. The aftermath of such an incident is simply unimaginable, often\nresulting in divorce and, in some cases, even suicide. This is why the USCCA so\nstrongly recommends having a good tactical flashlight on or at least near your\nhome-defense gun.<\/p>\n\n\n\n

Even with warnings like these, I still occasionally hear\nsomeone try to dismiss such concerns, saying something like, \u201cHey, if they\u2019re\nin my house, that\u2019s their problem, not mine.\u201d Oh, really? I can\u2019t help\nimagining such people trying to convince a typical jury why they had the right\nto shoot and kill an unarmed 13-year-old.<\/p>\n\n\n\n

Bearing all of this in mind, let\u2019s run down a few of the\nmost important realities concerning home defense and how to do everything you\ncan to avoid ever having to shoot.<\/p>\n\n\n\n

Assess Your Home Situation<\/strong><\/h2>\n\n\n\n

Survey the physical aspects of where you live and its\nvulnerabilities, and then use what you learn to establish your daily safety\nprotocols.<\/p>\n\n\n\n

Apartments and condos present the issue of access. Does your\nbuilding have limited (meaning key-card or locked) entryways, or can just\nanyone walk in and wander down the hallways at any hour of the day? What about\nparking? If outside, is the lot fenced? Well-lit? If you have garage or underground\nparking, how easy would it be for someone to gain entry? One case I recall\ninvolved a rapist who waited in some bushes for his victim to use her key card\nto raise the underground garage door and then ducked in behind her car before\nthe door closed. The same has occurred in single-family homes with automatic\ngarage door openers. Always check before entering.<\/p>\n\n\n\n

With townhouses or single-family homes, motion-activated\nlighting is helpful and relatively inexpensive. And with modern smartphone\ntechnology, you can now even get relatively sophisticated door locks with\nbuilt-in cameras for less than you might think.<\/p>\n\n\n\n

Speaking of which, door and window locks are obviously\nmandatory, but they only work if you remember to use them. Most police officers\nhave more than a few stories of victims who simply \u201cforgot\u201d to lock their doors\nand windows.<\/p>\n\n\n\n

A sliding glass door is a weak point. You need to ensure\nthat someone on the outside cannot lift the door out of its tracks, and you\nneed to immobilize the door if someone who can pick the lock attempts to gain\nentry. A wood or metal dowel or rod is a good idea, and there are also many\ninexpensive devices that will do the trick.<\/p>\n\n\n\n

Alarm systems, whether national name-brand services or\ndo-it-yourself systems available at very modest cost, are almost mandatory.\nWhether you opt for live monitoring is up to you.<\/p>\n\n\n\n

Dogs are proven deterrents. But even if you don\u2019t (or can\u2019t)\nhave a dog, there are inexpensive and clever ways to make it look like you do.\nA big water dish by the back door or one of those \u201cI Love My Pit Bull\u201d (or\nRottweiler, German Shepherd or whatever) stickers in a window can go a long way\ntoward causing a criminal to have second thoughts.<\/p>\n\n\n\n

Unfortunately, none of the above measures will do you any\ngood if you fail to use basic common sense. When I lived in Illinois years ago,\na serial rapist assaulted dozens of women in a very quiet suburban\nneighborhood. He always operated between late morning and early afternoon,\nafter having cased the homes where women were home alone. Dressed in workout\nclothes and running shoes \u2014 a common sight in the neighborhood \u2014 he\u2019d just\nknock on a victim\u2019s front door. He later testified that 80 percent of the time,\nwomen would just open their doors, at which point he forced his way in.<\/p>\n\n\n\n

His heinous career finally ended when a woman answered the door with a gun held behind her back. When he tried to force his way in, she jumped back, got the drop on him and called police. Sadly, after his highly publicized arrest, it was learned that a number of his previous victims had also possessed firearms but did not have them handy when they carelessly opened their doors.<\/p>\n\n\n\n

Thanks to movies and television, when people imagine a home\ninvasion, they usually imagine someone dressed in black, wearing a ski mask and\nholding a tire iron or crowbar. But the time of day, the number of assailants,\nwhether or not the assailants are armed, and where you happen to be at the time\nare impossible to predict; just ask the \u201cshower guy\u201d from a few paragraphs up.<\/p>\n\n\n\n

This should go without saying, but it unfortunately cannot:\nOne thing you should never do is set up what amounts to a trap or an ambush as\nsome incredibly foolish people have done. In one such case in Minnesota, the\nhomeowner was convicted of first-degree, premeditated murder. Remember, no\nmatter what your state\u2019s laws say about using deadly force to protect property,\njurors need to see you as a responsible citizen who took all reasonable\nprecautions and only used deadly force to protect human life. As a savvy lawyer\nfriend once commented, \u201cJuries simply don\u2019t like people killed over stuff.\u201d\nSimilarly, I generally recommend handguns for home defense. They are easier to\nhandle in close quarters, and, more importantly, research has shown that\nmilitary-style rifles can negatively affect outcomes. When an AR or AK is held\nup to a jury, some, unfortunately, lose all objectivity. As always, quality\nlegal representation and a rock-solid legal backup plan are essentials to the\nresponsibly armed lifestyle.<\/p>\n\n\n\n

Crunch Time<\/strong><\/h2>\n\n\n\n

OK, so even though you did everything right and took every\nprecaution, let\u2019s say you end up having to shoot an intruder. If this is the\ncase, it is absolutely essential that you follow the same procedure that you\nwould for any defensive shooting outside of your home. Call 911, say only your\nname, that you want to report a home invasion and that you need a police car\nand an ambulance, and then give your address. Then hang up and immediately call\nyour attorney. Tell him or her it\u2019s an emergency and that you need him or her\nright away.<\/p>\n\n\n\n

Finally, when the police arrive, remember that your\nresidence is now a crime scene. <\/p>\n\n\n\n

To arriving police, say only, \u201cOfficers, he tried to kill\nme. I don\u2019t wish to say anything more until my attorney is present.\u201d Then, no\nmatter how \u201cright\u201d you think you are, shut your mouth. Police will try to get\nyou to talk; don\u2019t. Wait for your lawyer. <\/p>\n\n\n\n

What happens after that is anyone\u2019s guess, but at least you will be able to present to a jury all of the reasonable and prudent measures you undertook to protect yourself before you had no choice but to use deadly force.<\/p>\n\n\n\n
