(Photo: Governor Phil Murphy Facebook)<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>In what the New York Times is calling a \u201c<a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.nytimes.com\/2019\/09\/10\/nyregion\/nj-gun-control.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gov-gun-makers-banks-gun-control\" title=\"NJ Gov. Vows to Stop Business with Gun Makers, Banks That Won\u2019t Embrace Gun Control\" target=\"_blank\">novel gun control strategy<\/a>,\u201d New Jersey Gov. Philip Murphy signed an executive order this week prohibiting state agencies from doing business with gun retailers and manufacturers that do not adhere to a vaguely-worded set of gun control measures outlined in the order. <\/p>\n\n\n\n<p>He also prohibited state agencies from doing business with\nbanks and financial institutions that have not \u201cadopted any code of conduct or\nprinciples related to gun safety or responsible sales of firearms.\u201d<\/p>\n\n\n\n<p>\u201cNew Jersey has committed to a whole-of-government approach to tackle gun violence,\u201d\u00a0Murphy said in a <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/nj.gov\/governor\/news\/news\/562019\/approved\/20190910b.shtml\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gov-gun-makers-banks-gun-control\" title=\"NJ Gov. Vows to Stop Business with Gun Makers, Banks That Won\u2019t Embrace Gun Control\" target=\"_blank\">press release<\/a>. \u201cI have signed comprehensive, commonsense gun safety and gun-violence intervention legislation, and now, under this executive order, my Administration is committed to making our communities safer by aiming to do business with gun dealers that have adopted best practices to reduce gun violence.\u201d<\/p>\n\n\n\n<p>Murphy\u2019s <a href=\"https:\/\/nj.gov\/infobank\/eo\/056murphy\/pdf\/EO-83.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gov-gun-makers-banks-gun-control\" title=\"NJ Gov. Vows to Stop Business with Gun Makers, Banks That Won\u2019t Embrace Gun Control\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">executive order<\/a> directs the state\u2019s Division of Purchase and Property to investigate whether the companies from which it purchases firearms and ammunition adhere to \u201cpublic safety principles related to firearms.\u201d<\/p>\n\n\n\n<p>For retailers, these principles include policies to <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>prevent, detect, and screen for the transfer of firearms to straw purchasers or firearm traffickers; <\/li><li>prevent sales to prohibited individuals; <\/li><li>protect against the theft of firearms and ammunition; <\/li><li>train vendor employees and have reasonable employment policies designed to ensure maximum compliance with the law; <\/li><li>assist law enforcement in the investigation and prevention of criminal access to guns; <\/li><li>and promote public safety. \u00a0<\/li><\/ul>\n\n\n\n<p>Firearm and ammunition manufacturers will be required to\nprove that they have \u201cstandards for retail dealers\u201d that adhere to the same\nlist of principles.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/court-appeals-upholds-new-jersey-magazine-capacity-limit\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gov-gun-makers-banks-gun-control\" title=\"NJ Gov. Vows to Stop Business with Gun Makers, Banks That Won\u2019t Embrace Gun Control\">Court of Appeals Upholds New Jersey Law Banning 15-Round Mags<\/a> <\/h2>\n\n\n\n<p>The New York Times reported that by \u201cprohibited individuals,\u201d the governor means the expanded list of persons used by New Jersey firearms retailers. Unlike federal requirements, this list also includes those convicted of domestic abuse, any violent crime, drug dealing, and anyone on a terrorist watchlist. <\/p>\n\n\n\n<p>The order fails to explain how retailers and manufacturers will\nprove that they adhere to any of these requirements, though the Times also reported\nthat officials will provide a specific set of guidelines within the next 30\ndays that \u201cwould likely be shaped by measures supported by gun control groups.\u201d\n&nbsp;<\/p>\n\n\n\n<p>The order also instructs state regulatory agencies to crack\ndown on banks and financial institutions that have not adopted \u201cany code of\nconduct or principles related to gun safety or responsible sales of firearms.\u201d <\/p>\n\n\n\n<p>Murphy does not specify what \u201cconduct or principles\u201d the\nTreasurer will be looking for, but if regulators take companies like Citibank\nas a model, it could include prohibiting sales of \u201chigh-capacity magazines\u201d and\nall firearms sales to individuals under age 21. <\/p>\n\n\n\n<p>Finally, Murphy instructs the Commissioner of Banking and\nInsurance to prohibit the sale, procurement, marketing or distribution of\ninsurance products that \u201cmay serve to encourage the improper use of firearms.\u201d <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/new-jersey-governor-400-carry-permits\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gov-gun-makers-banks-gun-control\" title=\"NJ Gov. Vows to Stop Business with Gun Makers, Banks That Won\u2019t Embrace Gun Control\">New Jersey Governor Proposes $400 Carry Permits, $100 Firearm ID Cards, $50 Handgun Purchase Permits<\/a> <\/h2>\n\n\n\n<p>The order (again) fails to define \u201cimproper use of firearms,\u201d\nbut it may be used to restrict the sale of insurance for those who carry\nconcealed firearms. Just last week, Murphy\u2019s Department of Banking and\nInsurance secured a $1 million fine from a company that backed the National\nRifle Association\u2019s Carry Guard insurance. <\/p>\n\n\n\n<p>Pro-gun groups in New Jersey argue that the governor\u2019s order\ncould put the lives of police officers in danger if they aren\u2019t able to access\nthe necessary equipment. <\/p>\n\n\n\n<p>\u201cIf they\u2019re going to put police officers\u2019 lives in danger\nbecause of politics, that\u2019s on the governor, not on the gun industry,\u201d Alex\nRoubian, the president of the New Jersey Second Amendment Society, told the\nTimes.<\/p>\n\n\n\n<p>The order goes into effect immediately. It applies to state troopers, prosecutor offices and local law enforcement agencies that make purchases through the state.
