The homeowner who fatally shot an intoxicated partygoer in Woodbine, Maryland last month will not face criminal charges, a state attorney announced this week.<\/p>\n\n\n\n

Howard County State’s Attorney Rich Gibson said<\/a> Tuesday that \u201cthere was no criminal violation in this incident,\u201d noting that the \u201chorrible loss of life in this case is a product of a series of unfortunate coincidences that all came together to end in a horrific result.\u201d\u00a0<\/p>\n\n\n\n

On July 21, around 1:04 a.m., Gerardo \u201cGary\u201d Espinoza began banging on the door of Charles Dorsey.\u00a0 Espinoza, whose blood alcohol content was .22 (almost three times the legal limit for drivers (.08) in the state), was confused.\u00a0 He mistakenly believed he was at the front door of his friend\u2019s house who had hosted the pool party he had attended that day. \u00a0<\/p>\n\n\n\n

Dorsey, not knowing the situation and having no idea who the shirtless man at his door was, grabbed a firearm and, from inside the home, instructed Espinoza to wait on the driveway.\u00a0 Dorsey\u2019s wife, meanwhile, was on the phone with 911.\u00a0<\/p>\n\n\n\n

Frustrated that a person he believed was his \u201cfriend\u201d was not letting him back inside the house, Espinoza began losing his temper.  Doorbell footage, recently released by Gibson\u2019s office, details the exchange. <\/p>\n\n\n\n

\u201cI\u2019m going to f*ck you up,\u201d exclaims Espinoza.  \u201cYou want a piece of this sh*t,\u201d<\/p>\n\n\n\n

Dorsey tells Espinoza to \u201cget away from the door,\u201d and to go back to the driveway.  <\/p>\n\n\n\n

\u201cThis was done in an effort to make [it] easier for the police to apprehend Espinoza,” Gibson explained.<\/p>\n\n\n\n

When Espinoza returned from the driveway he had about enough of what he must\u2019ve perceived was an elaborate prank.  He attempted to force his way inside the residence. <\/p>\n\n\n\n

\u201cDue to a defect in the door lock, the door when being physically jostled by Mr. Espinoza gives way [and] Mr. Espinoza breaches the household with his arm,\u201d Gibson said.<\/p>\n\n\n\n

\u201cEspinoza\u2019s behavior seemed to indicate a desire to harm the people in the house,\u201d Gibson continued. \u201cEspinoza did not literally mean the words he was saying at the door. But it\u2019s equally clear there was no way for the Dorsey family to know that he did not intend exactly what he stated.\u201d<\/p>\n\n\n\n

Dorsey fired one shot, hitting Espinoza in the shoulder and puncturing his lung.\u00a0 He would die as a result of the gunshot wound. \u00a0<\/p>\n\n\n\n

Espinoza\u2019s family was disappointed that there were no criminal charges brought against Dorsey, a lawful gun owner.  <\/p>\n\n\n\n

\u201cI\u2019m just dumbfounded they aren\u2019t going to pursue anything,\u201d Espinoza\u2019s sister, Rebecca Allen, told The Baltimore Sun.<\/a> \u201cMy brother clearly had been outside the door, and it was clearly locked. It\u2019s not like he tried to break his way in. He didn\u2019t break a window. We don\u2019t think this is right.\u201d<\/p>\n\n\n\n

Gibson clearly saw the situation differently, as it does appear that Espinoza did try to enter the residence, but he sympathized with the family’s reaction to the decision. <\/p>\n\n\n\n

\u201cI think it\u2019s reasonable that they not be thrilled with the outcome in the terms of our decision in this matter. But I\u2019d like to believe that they understand why we reached the conclusion that we reached. We didn\u2019t just look at the [doorbell camera] video and say, \u2018Ah, case closed; we got enough.\u2019 We looked at the other factors.\u201d<\/p>\n\n\n\n

\u201cMy honest belief is that Mr. Espinoza thought he was being pranked and the prank had gone on too far,\u201d he continued.<\/p>\n\n\n\n

Although Maryland has strict laws governing<\/a> the use of lethal force in self-defense situations, including a duty to retreat when confronted with a threat outside the home, the state recognizes the Castle Doctrine, which says essentially that a man’s home is his castle and his ultimate retreat. <\/p>\n\n\n\n

Though it was, indeed, a tragedy, Dorsey acted lawfully when he used lethal force against Espinoza. Our thoughts and prayers to both the Espinoza family and the Dorsey family. <\/p>\n\n\n\n\n\n\n\n
