<\/p>\n\n\n\n

A challenge to California\u2019s \u201cassault weapon\u201d ban was struck down by a federal judge last week, setting the stage for an appeal to the Ninth Circuit Court and, possibly, the U.S. Supreme Court. <\/p>\n\n\n\n

U.S. District Judge Josephine Staton of Santa Ana was the\nfirst federal judge to rule on the state\u2019s controversial law. She argued that \u201cassault\nweapons\u201d are \u201cincredibly effective killing machines\u201d and are not commonly used\nor necessary for self-defense.<\/p>\n\n\n\n

\u201cBecause the Court concludes that semiautomatic assault rifles are essentially indistinguishable from M-16s, which Heller<\/em> noted could be banned pursuant to longstanding prohibitions on dangerous and usual weapons, the Court need not reach the question of whether semiautomatic rifles are excluded from the Second Amendment because they are not in common use for lawful purposes like self-defense,\u201d Staton said.<\/p>\n\n\n\n

Plaintiffs in the case, all California gun owners who want to own the semi-automatic rifles California currently prohibits, were represented by the California Rifle and Pistol Association. In their suit, they cited a 2011 dissenting opinion<\/a> by now-U.S. Supreme Court Justice Brett Kavanaugh, who argued that Washington, D.C.\u2019s ban on semi-automatic \u201cassault weapons\u201d is unconstitutional under the Second Amendment and under the Supreme Court\u2019s Heller <\/em>decision that guaranteed the individual right to keep and bear arms. <\/p>\n\n\n\n

In Heller, <\/em>the\nCourt held that handguns are constitutionally protected because they have not\nhistorically been banned and they are in common use by law-abiding citizens.\nBecause \u201cthere is no meaningful or persuasive constitutional distinction\nbetween semi-automatic handguns and semiautomatic rifles,\u201d Kavanaugh argued,\nsemi-automatic rifles enjoy the same protections.<\/p>\n\n\n\n

Staton disagreed. <\/p>\n\n\n\n

Citing what appears to be a misreading of Heller, <\/em>Staton claimed that the \u201ccore\u201d\nof the Second Amendment is \u201cthe right of law-abiding, responsible citizens to\nuse arms in defense of hearth and home\u201d \u2013 not for all law-abiding purposes. Since\nsemi-automatic \u201cassault weapons\u201d are not commonly used in home defense, Staton\ncontinued, they can be restricted or banned under the Second Amendment as long\nas the state has a significant interest in doing so. <\/p>\n\n\n\n

Under this lower form of scrutiny, Staton could rule that\nsince \u201cassault weapons\u201d are dangerous, they can be banned.<\/p>\n\n\n\n

\u201cSemiautomatic rifles with non-fixed magazines, along with the other enumerated features, are incredibly effective killing machines, and the Attorney General\u2019s evidence strongly suggests that such weapons are disproportionately used in mass shootings and that, when they are used, more people are injured and killed,\u201d she said. <\/p>\n\n\n\n

\u201cTo be sure, Plaintiffs may have legitimate interests in\npossessing semiautomatic rifles within the AWCA\u2019s scope,\u201d she concluded. \u201cHowever,\nCalifornia has permissibly weighed those interests against the weapons\u2019\npropensity for being used for mass violence and concluded that the weapons\u2019\nlawful value is drastically outweighed by the danger they pose to California\ncitizens.\u201d<\/p>\n\n\n\n

The case can now be appealed to the Ninth Circuit Court. From there, gun rights advocates can appeal the case to the U.S. Supreme Court, which recently agreed to rule on a case pertaining to the carrying of firearms outside the home. <\/p>\n\n\n\n\n\n\n\n
