It\u2019s not just newcomers. Folks who have been armed all their lives and some of us outspoken types who are in it quite deep have this quiet (sometimes not so quiet) wish that self-defense could be, how should we put this \u2026 a little more robust?<\/p>\n\n\n\n

A little more bumper-sticker logic and a little less\nlegalese. Getting to Dirty Harry<\/em> the vermin without squandering life\nsavings on lawyers later. That would be more, shall we say, satisfying to a\ncertain kind of woman or man. It would certainly seem more American than\nconstantly watching bad guys skate while little people get trounced in courts.<\/p>\n\n\n\n

Or would it? When you read about the trials and tribulations\nfollowing a self-defense shooting, it makes your blood run cold. It\u2019s not fair.\nIf you\u2019re really innocent and some vicious assailant just contracted lead\npoisoning instead of confiscating your precious life, that should be the end of\nit, right? You deserve a medal and a free pizza or something. Police have a\nname for when bad guys receive those hot rounds \u2014 the \u201cgood-riddance factor.\u201d\nThat\u2019s true.<\/p>\n\n\n\n

When it really is an open-and-shut, absolutely slam-dunk\ncase of self-defense against a complete stranger who typically already has a\nviolent history and you survive, you do get pizza and people do buy you drinks.\n(The handcuffed ride downtown could be optional.) But that kind of clarity in\nhomicides isn\u2019t common.<\/p>\n\n\n\n

It\u2019s unfair \u2014 and it can help if you\u2019re a lone woman at home\nat night minding your own business and you never met the dead perps. Sometimes.\nIt could depend on your state or your state of mind. Which also isn\u2019t fair.\nBlind justice these days takes sides with \u201cdiverse\u201d causes and groups\nunimaginable just a few years ago \u2014 down to how much courts decide you didn\u2019t\nlike the deceased.<\/p>\n\n\n\n

\u201cHate crime\u201d effloresced from thin air in a novel, migrating\ninto our culture and courtrooms. Shooting someone criminally, for example, or\ndoing it with animosity, causes identical damage and should yield similar\npunishment, though political correctness rejects such logic. But I digress.<\/p>\n\n\n\n

The legal wrangling afterward (and dire warnings from us about\never using lethal force) are just natural outcomes of the nature of life\nitself. Wrangling over a person, now dead, is the biggest wrangle there is,\nbigger than who dented your car or who\u2019s missing what amount of cash. Life,\nbeing irreplaceable, generates the great debate, the greatest crimes and the\ngreatest consequences, forever, per incident. It\u2019s only natural. Get more used\nto that than tactical reloads.<\/p>\n\n\n\n

Maybe we\u2019re too deeply steeped in the American sense of\njustice we get from TV and movies, especially old Westerns. Scenes and plot\nlines are carefully staged, emotions are played, morality runs its course,\nfacts are established and every single person watching the picture \u2014 by the\nmillions \u2014 arrives at the exact same conclusion. That never happens for real.<\/p>\n\n\n\n

We imagine ourselves in similar pickles. Clear facts, an\nevil enemy who really is just that, perfect justification at the key moment,\npraise and a sense of victory on surviving, drinks on the house. It\u2019s not even\nthat way in the movies if you start watching carefully. That ain\u2019t reality \u2014\nand real cases are never even close. Start watching any screened gun activity\nfor whether the shots were fired with justification or what crime the fired\nshots, or even the pointed gun, are attempting to stop.<\/p>\n\n\n\n

Shots fired in public always represent a crime. Either shots are justifiable as defense against a crime or attempted crime, or the shots themselves are violations because there is no justification for them. Even (especially!) warning shots are criminal acts. You can\u2019t legally use a gun as an audible warning device; the law has no tolerance for this. It puts innocent people at risk, and unless you have a sound legal reason to use deadly force, you can\u2019t discharge a firearm out in public. In Westerns, they do it all the time without consequence \u2014 pure Hollywood nonsense.<\/p>\n\n\n\n

Practically everyone you deal with after a self-defense\nincident has never met you before. You meet all these new people on whom your\nlife depends, and most of what they have to go on is your story.<\/p>\n\n\n\n

How good of a storyteller are you? How well can the best\npossible recitation of a story tell what actually happened when you discharged\nyour sidearm? We\u2019re not even talking about truth or innocence any longer, or\nwhat actually happened; we\u2019re talking about defeating the system\u2019s attempt (and\napparent desire, it would often seem) to nail you to the wall.<\/p>\n\n\n\n

We\u2019ve gone over this before: It\u2019s always impossible to\nestablish \u201cprecisely what happened\u201d because that doesn\u2019t exist. It\u2019s an\nexistential problem: An observer to your north sees a 180-degree different\npicture than one to your south. Recall the clich\u00e9: two witnesses, four stories.\nEach time you (and they) recount the incident, it will change, and it will\nchange again over time as human memory changes, all without leaving recordings.<\/p>\n\n\n\n

An uninhibited manual decades ago recommended only carrying\nrevolvers because they don\u2019t eject evidence. In a perfect self-defense shooting\n(determined by you apparently), just leave, it said, because justifiable\nhomicide isn\u2019t criminal. Much blood, but no foul (it believed). If you\u2019re never\nfound, there won\u2019t be any questions to answer (it posited).<\/p>\n\n\n\n

Of course, leaving the scene that way could generate\nmultiple problems and, depending on the jurisdiction, could be criminal. If\nyou\u2019re caught and the trial finds you weren\u2019t justified, you fled a murder, and\nthat\u2019s very not good for your status as a reluctant participant.<\/p>\n\n\n\n

You might wish this were the Wild West, but it isn\u2019t. The best strategy remains Gunfighting Safety Rule No. 1: It\u2019s always better to avoid a gunfight than to win one.<\/p>\n\n\n\n
