(Photo:  Jimmy Emerson, DVM)<br \/><\/em> <\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>A former town judge in New York has been the victim of a personally and politically motivated gun confiscation scheme a full month before the state\u2019s new red flag law is set to take effect, according to the judge\u2019s lawyers at 2AWNY. <\/p>\n\n\n\n<p>Law enforcement in Allegany County seized the firearms\nbelonging to former Town of Allen Justice Bridgette A. Tojek after County Court\nJudge Thomas P. Brown suspended her license to own a handgun pending an\nupcoming hearing on July 31. <\/p>\n\n\n\n<p>Tojek\u2019s attorneys at the western New York gun-rights group 2AWNY released a statement arguing that the judge\u2019s actions were prompted by personal and political animus rather than any valid disqualifying behavior. <\/p>\n\n\n\n<p>\u201cThey leveraged red flag-style gun confiscation for the\npurposes of personal retribution,\u201d 2AWNY\u2019s Steve Felano told GunsAmerica. \u201cThey\ndislike her socially and politically, and the fact that she owns guns makes her\na target.\u201d<\/p>\n\n\n\n<p>Tojek\u2019s firearms were confiscated after a single member of the Allegany County Board submitted an <em>ex parte <\/em>affidavit requesting Tojek\u2019s pistol license be suspended. Felano said the board member had a personal grudge against Tojek after the former justice said disparaging things about the board member in public. <\/p>\n\n\n\n<p>An Allegany County Judge, Terrence M. Parker, also claimed\nthat Tojek \u201ccontinually disparaged me and my family publicly in her Court and\nin Town meetings.\u201d Judge Parker asked Judge Brown to review Tojek\u2019s pistol\npermit application because he \u201cwould have a predisposition to deny her\napplication.\u201d <\/p>\n\n\n\n<p>Judge Parker made that request in April of last year; fifteen months later, Judge Brown suspended Tojek\u2019s license and seized her firearms. <\/p>\n\n\n\n\n\n\n\n<p><\/p>\n\n\n\n<p>As a motivation for Judge Brown\u2019s decision, Felano also mentioned an incident involving Judge Parker\u2019s son, who was cited for a traffic violation but didn\u2019t show up to his court date. When Tojek levied the full penalty on Judge Parker\u2019s son, Felano claims, the judge wasn\u2019t happy.<\/p>\n\n\n\n<p>\u201cShe didn\u2019t play by the good-ol\u2019-boy\u2019s rules and dismiss the\nticket based on nepotism or familiar relations,\u201d Felano said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/teachers-now-have-confiscation-power-under-new-yorks-red-flag-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"exclusive-new-york-judge-issues-red-flag-style-gun-confiscation-a-full-month-before-the-law-takes-effect\" title=\"Exclusive: New York Judge Issues Red Flag-Style Gun Confiscation a Full Month Before the Law Takes Effect\">Teachers Now Have Confiscation Power Under New York\u2019s Red Flag Law<\/a> <\/h2>\n\n\n\n<p>Judge Brown hasn\u2019t provided any further rationale for his\ndecision. In a letter to Tojek, Brown simply stated the time and place of the\nhearing and that the court would not provide her with a lawyer. He may have\nleft one clue as to his court\u2019s thought process, however, when he asked Tojek\nto bring \u201cany documents with you that would aid the court in deciding this\nmatter, such as mental health evaluations, etc.\u201d<\/p>\n\n\n\n\n\n\n\n<p><\/p>\n\n\n\n<p>GunsAmerica contacted Judge Brown\u2019s office but was rerouted to the Public Information Division of New York\u2019s court system. Director of Public Information Lucian Chalfen said that Judge Brown cannot comment on this case since it is a pending matter in his court.<\/p>\n\n\n\n<p>&#8220;This hearing, however,&#8221; Chalfen said, &#8220;stems from New York State Town and Village Justice Bridgette Tojek\u2019s being relieved from her judicial duties by the Deputy Chief Administrative Judge who supervises all judges outside of New York City because of her behavior on the bench.&#8221;<\/p>\n\n\n\n<p>Chalfen did not elaborate on Tojek&#8217;s actions, but asserted that Tojek will have &#8220;full due process rights at the hearing, that would include her lawyer being able to call witnesses and state her case to the Judge.&#8221; <\/p>\n\n\n\n<p>This &#8220;due process,&#8221; of course, will happen after Tojek&#8217;s firearms have already been taken away. <\/p>\n\n\n\n<p>Felano clarified that Judge Brown didn\u2019t actually cite New\nYork\u2019s new red flag law as justification for the seizure, but the judge\u2019s\nseize-the-guns-now-ask-questions-later strategy will soon be enshrined in New\nYork state law \u2013 and other states should take notice. Especially in states with\n\u201cmay issue\u201d permitting requirements, red flag laws are ripe for abuse. <\/p>\n\n\n\n<p>\u201cYou see all the hallmarks of red flag laws happening here before the thing is even active, and it should be a wake-up call for people in New York State and all across the country,\u201d Felano said. \u201cIn states with these \u2018may issue\u2019 pistol permitting systems, red flag type confiscation has been happening for a long time, but no one\u2019s been aware of it and it hasn\u2019t been as easy. But now it\u2019s going to be very easy [in New York] because these unconstitutional means of confiscation will become enshrined in law in August.\u201d<\/p>\n\n\n\n<p>\u201cI, along with other Second Amendment advocates, have\npointed out that this type of gun confiscation will be abused by people who want\nto punish their enemies. And here you have a situation as a case in point of\nthat very thing,\u201d Felano concluded.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/new-york-anti-gun\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"exclusive-new-york-judge-issues-red-flag-style-gun-confiscation-a-full-month-before-the-law-takes-effect\" title=\"Exclusive: New York Judge Issues Red Flag-Style Gun Confiscation a Full Month Before the Law Takes Effect\">New York Passes Sweeping Anti-Gun Bills Disarming Teachers, Requiring 30-Day Waiting Period<\/a> <\/h2>\n\n\n\n<p>Tojek\u2019s case also shows the constitutional liabilities of\nNew York\u2019s pistol permit requirement.<\/p>\n\n\n\n<p>\u201cJudge Terrance admits in his letter that Ms. Tojek\u2019s protected\nFirst Amendment actions would sway his judgment in granting or denying a permit,\u201d\nFelano argued.<\/p>\n\n\n\n<p>\u201cAs you can see here, we have one single judge acting in an administrative\ncapacity who has the total power to suspend or give full force to someone\u2019s\nSecond Amendment constitutional rights, and is allowing a personal matter to\naffect that.\u201d<\/p>\n\n\n\n<p>2AWNY is a \u201cforce multiplier\u201d for the numerous gun-rights groups operating in western New York, Felano said.
