Phil Murphy signed legislation Tuesday that forces firearms retailers in the Garden State to sell smart guns. &nbsp;<\/p>\n\n\n\n<p>That\u2019s not all though. Murphy, a progressive Democrat, also put his John Hancock on three other bills that work to make New Jersey\u2019s gun laws the \u201ctoughest\u201d in the nation.&nbsp;<\/p>\n\n\n\n<p>\u201cThe scourge of gun violence is a pervasive problem that affects our entire nation,\u201d said Gov. Murphy, in a <a href=\"https:\/\/nj.gov\/governor\/news\/news\/562019\/approved\/20190716b.shtml\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gun-stores-must-now-sell-smart-guns\" title=\"NJ Gun Stores Must Now Sell Smart Guns\">press release obtained<\/a> by GunsAmerica.&nbsp; &nbsp;<\/p>\n\n\n\n<p>\u201cI am proud to work with our legislators to implement some of the toughest gun laws in the country to protect our residents and make our communities safer for all,\u201d he added.<\/p>\n\n\n\n<p>Per Gov. Murphy, the bills signed into law include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>S101 (Weinberg, Codey\/Johnson, Vainieri Huttle, Wimberly) &#8211; Establishes commission to approve personalized handguns; requires firearm retailers to sell personalized handguns.&nbsp;<\/li><li>S3897 (Weinberg, Greenstein\/Greenwald, Reynolds-Jackson) &#8211; Criminalizes purchase, transfer, or possession of certain weapons and ammunition by persons convicted of certain crimes; establishes crime of transferring or possessing firearm without serial number.<\/li><li>A4449 (Tully, Swain\/Singleton, O\u2019Scanlon) &#8211; Establishes crime of soliciting transfer of firearm by disqualified person. &nbsp;<\/li><li>A3896 (Downey, Houghtaling, Schaer\/Cryan) &#8211; Requires AG and Commissioner of Health to establish suicide prevention training course and informational materials for firearm retail dealers.<\/li><\/ul>\n\n\n\n<p>In addition to requiring FFLs to sell at least one smart gun, S101 also rescinded an ill-conceived 2002 law that required gun dealers to sell smart guns exclusively in New Jersey three years after they became available for \u201cretail purposes.\u201d<\/p>\n\n\n\n<p>Murphy explained during the press conference how the law, known as the <a href=\"https:\/\/en.wikipedia.org\/wiki\/New_Jersey_Childproof_Handgun_Law\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gun-stores-must-now-sell-smart-guns\" title=\"NJ Gun Stores Must Now Sell Smart Guns\">New Jersey Childproof Handgun Law,<\/a> backfired in the face of gun-control advocates as it put an \u201cenormous amount of pressure on the gun manufacturers to not pursue the (research and development) that was necessary\u201d to bring viable smart gun technology to the marketplace.<\/p>\n\n\n\n<p>As GA previously <a href=\"https:\/\/www.gunsamerica.com\/bill-would-force-gun-dealers-to-sell-smart-guns\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gun-stores-must-now-sell-smart-guns\" title=\"NJ Gun Stores Must Now Sell Smart Guns\">reported<\/a>, the gun industry doesn&#8217;t oppose smart gun development.  What it rails against is when the government tries to force the issue. <\/p>\n\n\n\n<p>\u201cThe firearms industry is not opposed to the development or marketing of user-authorized (\u201csmart gun\u201d) technology, but we continue to oppose any form of government mandate, including telling a retailer to stock a product in the attempt to create demand that we frankly do not yet see,\u201d the National Shooting Sports Foundation said in a statement to GA in 2015.<br \/>&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/new-jersey-governor-400-carry-permits\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gun-stores-must-now-sell-smart-guns\" title=\"NJ Gun Stores Must Now Sell Smart Guns\">New Jersey Governor Proposes $400 Carry Permits, $100 Firearm ID Cards, $50 Handgun Purchase Permits<\/a><\/h2>\n\n\n\n<p>While compelling small business owners to sell products they may not want to put on their shelves is troubling, what may be the most concerning of all the bills signed is S3897, which expands the list of prohibited persons in the state, those who are banned from buying guns, to include those convicted of carjacking or making terroristic threats.&nbsp; While carjacking is a pretty obvious offense, a \u201cterroristic threat\u201d is less so. &nbsp;<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/aielloharris.com\/practice-areas\/criminal-law\/violent-crimes\/domestic-violence\/terroristic-threats\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gun-stores-must-now-sell-smart-guns\" title=\"NJ Gun Stores Must Now Sell Smart Guns\">New Jersey law firm Aiello &amp; Harris<\/a>, the standard for defining the offense, which is a 2nd- or 3rd-degree crime depending on the circumstances, is as follows:&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"310\" title=\"NJ Gun Stores Must Now Sell Smart Guns\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2019\/07\/FoundGuiltyTerroristicThreats-1024x310.png\" alt=\"NJ Gun Stores Must Now Sell Smart Guns\" class=\"wp-image-112922\" srcset=\"https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/07\/FoundGuiltyTerroristicThreats-1024x310.png 1024w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/07\/FoundGuiltyTerroristicThreats-150x45.png 150w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/07\/FoundGuiltyTerroristicThreats-400x121.png 400w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/07\/FoundGuiltyTerroristicThreats-768x232.png 768w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/07\/FoundGuiltyTerroristicThreats.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Is caustic or harsh online banter enough to qualify as a &#8220;terroristic threat&#8221;?  If so, New Jersey gun owners are going to have to extra careful about what they say publicly.  Saying the wrong thing to the wrong person at the wrong time may end up costing them their 2A rights under this new law.   <\/p>\n\n\n\n<p>Looking ahead, Gov. Murphy is going to continue to pursue an anti-2A agenda.  NJ.com <a href=\"https:\/\/www.nj.com\/politics\/2019\/07\/murphy-just-made-njs-gun-laws-even-tougher.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"nj-gun-stores-must-now-sell-smart-guns\" title=\"NJ Gun Stores Must Now Sell Smart Guns\">reports<\/a> that there are a handful of other gun-control bills being considered, including legislation that would require background checks and tracking for ammo sales, price hikes for carry permits and Firearm ID cards, and mandatory safety training every 4 years, among others.  <\/p>\n\n\n\n<p>&#8220;Governor Murphy&#8217;s Gun Safety Package 2.0, will surely be followed by version 3.0.
